Order to recompute retiral benefits
Tribune News Service

Chandigarh, November 13
Allowing two writ petitions, Mr Justice Mehtab Singh Gill of the Punjab and Haryana High Court today directed the Bhakra Beas Management Board, the state of Punjab and another respondent to recompute the retiral benefits due to former employees.

Pronouncing the orders, Mr Justice Gill of the High Court also directed that the pensionary benefits should be granted accordingly. The Judge further directed the respondents to carry out the entire exercise within three months.

In their petition, Mr Pawan Kumar of Una district and Mr Daulat Ram of Ropar district, besides other petitioners, had earlier sought revised pension, gratuity and other pensionary benefits, with “commutation of pension and leave encashment on the basis of the last pay drawn by them”.

After hearing the arguments and going through the record, the Judge observed: “Counsel for the petitioners at the very onset has drawn my attention to a judgement passed by a Single Bench of this Court on May 4 wherein it has been held that the petitioners retiring from the service of BBMB should be given pensionary benefits on the basis of the pay scale drawn by them at the time of their retirement. Since the petitioners’ case is squarely covered by the judgement, the present writ petitions are allowed”.

Writ plea dismissed

Imposing costs of Rs 10,000, Mr Justice Jawahar Lal Gupta and Mr Justice Ashutosh Mohunta of the High Court have dismissed a writ petition filed by Mr Kuldip Rishi — ex-president of Bhadour Municipal Council — for quashing a notification issued on September 7 last year “by which a no confidence motion was notified to have been duly passed against him”.

Pronouncing the orders, the Judges observed: “The pleas which are sought to be raised by the petitioner cannot be sustained. It cannot be said that there was any violation of the principle of natural justice or that any prejudice was caused to the petitioner. We find no merit in this writ petition. It is consequently dismissed. The respondents shall be entitled to their costs assessed at Rs 10,000”.
