CONSUMER COURT
Consumer gets 18 pc interest from PSEB
Our Correspondent

Ludhiana, December 7
The State Consumer Disputes Redressal Commission has directed the Punjab State Electricity Board (PSEB) to pay interest at the rate of 18 per cent on the amount that remained deposited illegally with it from the date of deposit till the actual payment to Mr Dharamvir Bajaj, a resident of Kundanpuri, Civil Lines.

Earlier, on April 6, 2001, the District Consumer Disputes Redressal Forum, Ludhiana had observed that a demand of Rs 13,714 on account of theft of energy from the consumer, was illegal. The forum had quashed the demand and directed the PSEB to refund Rs 4,170, which was deposited against the said demand. In the order, the forum had also directed the PSEB to restore the electricity connection of the consumer and to pay Rs 500 as cost of litigation to the consumer within 15 days of receipt of order.

But the dissatisfied consumer appealed to the state commission for more relief. The representative of the complainant, Mr. S.S. Sarna, stated that the required relief had not been granted to the consumer as he had to suffer a lot due to disconnection of electricity for eight months. Moreover, the consumer had not been granted interest on the amount which had remained illegally deposited with the PSEB.

Mr Sarna demanded from the state commission that, “The consumer may be allowed Rs 200 per day against business loss for eight months of disconnection of electricity which amounts to Rs 54,000 till the electricity connection was installed at his ladies shawl manufacturing unit, and in addition to that, an interest at the rate of 18 per annum should be allowed on the amount remained illegally deposited with the PSEB.”

The state commission held that the consumer must get interest at the rate of 18 per cent per annum from the date of deposit till actual payment of Rs 4,170, that illegally remained with PSEB, but the respondent could not be directed to pay Rs 54,000 on account of loss occurred to him due to illegal disconnection of electricity. It was further stated that there was no mention of machines operating and the actual loss occurred, so the PSEB could not be directed to pay Rs 200 per day for eight months as business loss without any basis.

PSEB fined for wrong billing
Our Correspondent

Ludhiana, December 7
The District Consumer Disputes Redressal Forum has imposed a fine of Rs 15,000 on the PSEB for sending wrong bills for a period of three years to K.K. Industries. The forum has also directed the PSEB to pay Rs 500 as a cost of litigation to the complainant.

According to the complaint, a memo was issued to the industry mentioning that due to wrong calculations Rs 2.74 lakh was due on its account for a period between November 18, 1997 and November 17, 2000. The consumer stated that there was clear deficiency on the part of the PSEB for issuing wrong bills.

The PSEB pleaded before the forum that a new meter having multiplier of (4/3) was installed on the premises of the complainant. It maintained that while calculating the bills the multiplying factor (4/3) was not applied and the amount was legally recoverable from the complainant. The respondent stated that the demand had been rightly raised and the consumer was bound to pay it and there was no deficiency in services.

The forum observed that, however, the demand had been rightly raised but there was clear deficiency in services on the part of the PSEB for not sending rightly calculated bills. The forum stated that it was the duty of the PSEB to issue correct bills. The forum further that due to wrong billing of the respondent, the consumer suffered a lot and had to make a payment of Rs 2.76 lakh in lump sum. The forum held that there was clear deficiency in services and directed the PSEB to pay Rs 15,000 as compensation.
