Lucky’s wife case: HC issues notice of motion Chandigarh, May 29 However, the court did not accept the prayer of her counsel for interim stay on her arrest till the next date of hearing. On May 23, the Additional District and Sessions Judge (ADSJ), Chandigarh, Mr B.K. Mehta, had rejected the plea for the grant of anticipatory bail to Ms Harneet in the case. In her petition, Ms Harneet has stated that a co-accused in the same case, Ms Jaspal Kaur Bhattal, has been granted anticipatory bail by a Chandigarh court while her similar plea was turned down. She has claimed that the case against her is the result of a conspiracy by her husband’s political rivals. Ms Harneet had been booked for theft after the salesman, Raju, the main accused in the matter, had allegedly confessed to his crime and had told Crime Branch officials said that Ms Harneet and Ms Bhattal had also been involved in the theft. He had handed over clothes to the two ladies on three different occasions. The two had been booked as the police claims to have sufficient evidence to believe that they were hand in glove with Raju. |

High Court upholds 105-year-old Act Chandigarh, May 29 A petition filed by a Chandigarh resident, Sanjeev Kumar, had challenged the provisions of the Act on the ground that it was unconstitutional and against the spirit of Article 14 of the Constitution which provided for equality before law. He had also challenged it on the ground that it had outlived its utility. He had also contended that other Central Government employees and members of the paramilitary forces were not entitled to such concessions. A Division Bench, comprising Mr Justice H S Bedi and Mr Justice Ranjit Singh, however, ruled to the contrary and dismissed the petitioner's contentions. Section 3(a) of the Indian Tolls (Army & Air Force) Act, 1901, provides for toll tax exemption on all public or private roads and bridges in India to officers and men of the regular forces whether they are on duty or not. Further civil vehicles and animals moving under military orders, are also exempted from payment of toll tax. The Act also has an overriding clause which causes it to override all other Acts or directions by any legislature by the central or state governments in India. In the past there had been several controversies over this issue, with private toll operators at several places violating provisions of the Act and charging toll even from military vehicles moving on official duty. The controversy was by and large settled when the Union Ministry of Transport and Highways issued instructions to all toll operators in the country last year reiterating that armed forces personnel are exempted from payment of toll. |
