Clean chit to Capt, 36 MLAs

Just before Punjab goes to polls, Congress chief ministerial candidate Capt Amarinder Singh and 36 other MLAs in the outgoing state Assembly got a shot in the arm with the Election Commission clearing their names in the office of profit case.

EC sources said the poll panel had forwarded its opinion to the state Governor, who had referred the case the commission following a complaint lodged by SAD leader Kanwaljit Singh and BJP leader Prashanr Kumar seeking their disqualification for holding offices of profit.

The sources said the poll panel cleared their names citing the blanket exemption given in the existing law in the state under which even parliamentary secretaries were covered.

Apart from the Chief Minister, other MLAs against whom OoP case have been cleared were Joginder Singh Mann, Shavinder Singh Kathunangal, Aruna Chaudhary, H.S. Thekedar, Ram Lubhaya, Randeep Singh, Surinder Dabur, O.P. Soni, Gurjant Singh Kuttiwal, Romal Chand, Dr Mohinder Kumar Rinwan, Ashok Sharma, Tript Rajinder Singh Bajwa, Jasbir Singh Gill, Ravinder Singh Sandhu, Kanwaljit Singh Lalli, Gurkanwal Kaur, Jugal Kishore Sharma, Prakash Singh Bhatti, Rana Gurmeet Singh Sodhi, Malkiat Singh Birmi, Dr Harbans Lal, Harbans Kaur Dullon, K.P. Singh Rana, Prakash Singh, Dr Raj Kumar Verka, Razia Sultana, Sandhu Singh Dharamsot, Sukhhjinder Singh Randhawa, Sunil Jakhar, Ashwani Sekhri, Hans Raj Josan, Rakesh Pandey, Gurbinder Singh Atwal, Raghunath Sahai Puri and Randeep Singh Nabha.

The clearance given by the commission comes ahead of a high voltage campaign by Prime Minister Manmohan Singh for two days from tomorrow and Congress president Sonia Gandhi later for the Assembly poll in the state where the Congress is making a determined bid to retain power.

While Mr Manmohan Singh would be in the state on February 5 and 6 to canvass support for the Congress, Ms Gandhi would be there on February 7 and 10.

The ambiguity on the office of profit is expected to be resolved when the Joint Parliamentary Committee, headed by senior Congress MP Iqbal Ahmed Sardagi, going into the issue is likely to submit its report “on the first day of the last week” of the Budget session that begins on February 23.

The committee has been asked to provide generic and comprehensive definition of what entails ‘office of profit’ that can be acceptable and implementable across the country in all the state legislatures.

Set up in August this year, it was also to look into constitutional and legal positions relating to office of profit and suggest in depth definition of the issue.
