Pereira case: HC takes suo motu notice

The Bombay High Court today took suo motu notice of a hit-and-run case where the son of a city businessman, who ran over seven pavement dwellers last year, was sentenced to six months’ imprisonment by a fast-track court.

Amidst allegations that the prosecution goofed up in a big way, Chief

Justice Swatanter Kumar and Justice S.C. Dharmadhikari of the Bombay High Court today issued notices to the Mumbai police in the case and asked the law enforcement agency to submit to the court all documents, including post mortem reports.

Notices have been issued to the state government, the Mumbai police and the investigating officer at Khar police station as to ‘why there were loopholes’ in the investigation.

Hearing on the case has been fixed for May 3. Last week the accused Alistair Pereira (21) was found guilty of causing the death of seven people, including a pregnant woman and two children.

However, the charge of culpable homicide against him was dropped and Pereira was fined Rs 5 lakh and subsequently released on bail pending appeal.

The fast-track court had passed a number of strictures against the Mumbai police for its shoddy investigation, which allowed the convicted person to walk out on bail.
