Man sentenced to jail in cheque-bounce case
Tribune News Service

Ludhiana, July 31
Holding a Delhi-based businessman - Nand Lal Sharma guilty in a cheque bounce case, the court of Additional Chief Judicial Magistrate K.S. Cheema has ordered him to pay half of the cheque amount, Rs 7.5 lakh, as compensation to the complainant.

Apart from this, the court also sentenced Sharma to one-and-half-year imprisonment. A fine of Rs 5,000 was also imposed upon the accused.

These orders were pronounced by the court while deciding on the complaint filed by one Chaman Lal Batra of Krishna Nagar, Ghumar Mandi, Ludhiana. The complainant submitted that the accused had borrowed a sum of Rs 15 lakh from him on the pretext of promoting his business. The amount was given with a clear understanding that the accused would return it on demand.

The accused had taken the amount for investing it in his company - Rice Poly Private Limited, Dehlon. In order to discharge the liability, the accused had issued two cheques worth Rs 7 lakh and Rs 8 lakh out of his bank account being operated at Bank of India's Connaught Circus, New Delhi branch. It was assured that the cheques would be cashed on its presentation, added the complainant.

But when the cheque was presented it was dishonoured as the account was closed.

Thereafter, a legal notice was served upon the accused on October 3, 2002, requesting him to make the payment. But, the complainant said, he did not make the payment.

On the other hand, the accused pleaded innocence and claimed false implication. He submitted that actually no loan was taken but blank cheques were issued. Later on he met with an accident and had requested the accused to return the cheques or destroy them.

But after looking at the evidence on record, the court found him guilty.
