Taj corridor scam: SC reserves order

The Supreme Court today reserved its verdict on an application challenging Uttar Pradesh Governor T.V. Rajeshwar’s order denying the CBI permission for prosecuting state Chief Minister Mayawati in the multi-crore Taj corridor scam case.

The application challenging the Governor’s order issued in May turning down state council of ministers recommendation, made during the tenure of Mulayam Singh regime was filed by advocate Ajay Agrawal, the complainant in the case.

But a Bench of Justices S.B. Sinha, S.H. Kapadia and D.K. Jain had ordered that Agrawal be kept away from the case and advocate Krishan Mahajan, acting as amicus curiea to assist the court, should instead plead on his behalf.

The court though indicated that there could be some problem relating to the jurisdiction issuing a direction on Governor’s order as to what could be the appropriate forum for challenging the Governor’s order still it reserved the verdict to give the final decision.

Mahajan in his petition had also challenged the order of the trial court issued on February 15 asking the CBI to seek sanction for prosecution of Mayawati, saying it was not the duty of the court to issue such a direction as it was purely the job of prosecuting agency to move the sanction plea.
