No dependent status for married kin of deceased soldier: HC
Saurabh Malik
Tribune News Service

Chandigarh, January 13
A latest judgment of the Punjab and Haryana High Court makes it clear that tying of knot by a deceased soldier’s kin will result in his parting of ways with the dependent status. A Division Bench of the high court has, in fact, upheld provisions of a policy in this regard. The ruling by the Bench of Justice Ashutosh Mohunta and Justice Rajan Gupta comes on a petition filed by Gurpreet Singh. He had sought quashing of a decision dated June 13, 2005, by a high-powered committee.

The committee, vide the decision, had rejected his case for appointment to a class-III post under ‘appointment of honours and gratitude to the dependent of war heroes’ policy. The petitioner had also sought a writ to declare “instruction, rule and regulation prohibiting employment of married son as illegal and arbitrary.”

Gurpreet‘s brother Baljit Singh had died during ‘Operation Parakaram’ in November 2002. The petitioner had applied for a government job claiming to be dependent of the deceased. But he was informed that the committee had rejected his case for appointment on grounds that he was “married” and not a dependent of the deceased.

Counsel for the petitioner had contended rejection of claim on the ground of being married was arbitrary.

Justice Gupta asserted: “We are not convinced with the argument of the counsel that there can be no classification on the basis of marital status…. We are not convinced that such a policy is arbitrary or the classification on the basis of marital status is bad.”

Tehelka prosecutor faces court martial for contempt
Vijay Mohan
Tribune News Service

Chandigarh, January 13
A lieutenant colonel who had served as the prosecutor in the court martial of two senior officers respectively in the infamous Tehelka scam is now himself facing a possible trial by general court martial for contempt and other charges, it is learnt.

Sources said the officer, Lt Col Sanjay Sitanshu, is facing five charges of contempt of court for allegedly using injudicious words and disrupting proceedings during the court martial of a jawan tried for murder.

In addition, he is facing two charges for disobedience and one charge for overstaying leave under various provisions of the Army Act. He is at present attached to an air defence regiment in Kota, where hearing of charge (HOC) is currently under progress.

He was detailed as the defending officer of Nk Sanjeev Sharma who was later convicted for shooting a fellow army man. The said remarks were made by the officer during this trial.

After the conclusion of the murder trial, Headquarters South-Western Command had ordered that he be attached with an armoured unit in Hisar. Later that order was withdrawn and a fresh order was issued to move him to Kota. The officer had earlier moved the Gwalior High Court against his attachment, but the court had dismissed the petition.

His counsel, Arvind Moudgil, said Colonel Sitanshu had written to the Army chief, pointing out that while the attachment order had mentioned a single charge against him, now eight charges had been brought up against him. This, he has contended, shows that he is being implicated in false cases and the matter should be investigated.
