CHB decides: No transfer of properties on GPA, SPA

The Chandigarh Housing Board (CHB) has decided not to transfer properties on the basis of the general power of attorney (GPA) and the special power of attorney (SPA). It will return all applications submitted before January 10 this year when a ban on such transfers was imposed.

Sources said the decision in this regard was taken during a meeting of the Board of Directors held on Saturday.

In pursuance of the Supreme Court judgment delivered on October 11, 2011, in the case of Suraj Lamp and Industries Pvt Ltd vs the State of Haryana, the UT Finance Department had issued an order on January 10, which banned transfer of properties on the basis of the GPA and the SPA. The sudden move left a large number of property owners in the lurch as their cases of transfer of property were put on hold.

The CHB stopped entertaining such transfer cases after the Finance Department issued directions to all departments that no transfer of title or mutation shall be carried out merely on the basis of the GPA and the SPA. The order further stated that the wills executed, along with the GPA and the SPA, shall also not be considered for effecting the mutation.

More than 1,000 cases pending in the Tatkal scheme had also been put on hold. The CHB, in its policy approved in 2015, had allowed transfer of dwelling units on the basis of GPA where GPA/SPA and agreement to sell/will were executed on or before October 11, 2011.

Plan for speedy disposal of cases okayed

The CHB has approved the plan for the smooth and speedy disposal of works. It has been decided to publish booklet giving all information regarding the procedure for various works and delegation of powers to low-rung officials. The transfer cases on the basis of sale deed, transfer deed and gift deed will be disposed of at the level of the branch heads. It has also been decided to adopt e-stamp facility for the execution of Deed of Conveyance.

Gen sets for lifts at Sec 63

Accepting the demand of the allottees of the Sector 63 housing scheme, the CHB has decided to instal diesel generator sets for elevators. The Board of the directors approved the agenda in this regard on Saturday.

Need-based changes: Consultant to be hired

The CHB has also given the go-ahead for appointing a consultant to get the design audit done for all categories of houses in connection with need-based changes. A committee was formed to make recommendations for allowing the need-based changes. The panel had recommended hiring a consultant. The consultant agency will examine whether the construction made by the owners are structurally sound or not and recommend the relaxation accordingly.
