Cracking the whip on Shalimar Estates Pvt Ltd for not obeying its order even after the conviction of the realty firm owners, the UT State Consumer Commission today ordered to attach 40 acres landed property at Naggal (35 acres) and Alipur (over 4 acres) villages in Panchkula.
The court acted on an execution petition of four different petitioners moved by advocate Ramandeep Singh Pandher in this regard.
In one of these cases, the complainant, Banarsi Dass Gupta, had booked a showroom at Shalimar Mall by paying Rs 23,30,000 in instalments. However, he was not given delivery as the construction work was abandoned by the company. He later approached the consumer court, which, in 2010, ordered the firm to refund the whole amount and imposed a fine of Rs 1 lakh on it along with Rs 10,000 as the litigation cost. Similar orders were passed in three separate cases though the payment amount varied in the plaints.
The realtor gave him post-dated cheques which bounced. Following this, an execution petition was moved in the court last year based on which the commission had issued non-bailable arrest warrants against Shalimar managing director RK Aggarwal and his wife and director Kamlesh Aggarwal. However, they have been evading arrest, not only in this case but in around 15 other cases as well.
When the owners did not act, the advocate moved the present execution application to realise the decretal amount. It was stated that the amount be recovered by attaching and selling the property of the judgment debtors. Thus, the court of Justice Jasbir Singh (retd), president of the commission, ordered the attachment today.
Last December, the commission had ordered to attach the Sector 8 house of the managing director and the director of Shalimar. However, they had got a stay from the Punjab and Haryana High Court on the plea that this was their only residential place. The case is pending in the court.
