First complaint under RERA filed against CHB

CHANDIGARH:One month after the Real Estate (Regulation and Development) Act, 2016, came into effect, a resident of Sector 51, SD Rattan, has filed a first complaint against the Chandigarh Housing Board (CHB) with the interim chairman of the RERA KK Jindal.

One month after the Real Estate (Regulation and Development) Act, 2016, came into effect, a resident of Sector 51, SD Rattan, has filed a first complaint against the Chandigarh Housing Board (CHB) with the interim chairman of the RERA KK Jindal. 

Rattan alleged in the complaint that the Board has suppressed full facts while launching the housing scheme of 200 flats in sector 51 in April 2016 which caused loss and harassment to him.  Rattan has demanded to issue direction for the CHB to pay compensation and return Rs 69, 000 amount which the CHB deducted when he surrendered the flat allotted to him under the scheme with interest. The CHB fixed Rs 69 lakh price for the two bedroom flat under the scheme. Rattan said that he was allotted the flat through the draw in the scheme. He said that soon after the allotment he was shocked to know that the certain portion ( 4 kanal) of the land was disputed and was in the possession of the saw mill owners . The court also stayed the dispossession of the land.  The fact was also confirmed by the information which he got under the RTI Act from the CHB. He said that on knowing the fact he had decided to surrender the flat fearing the delay in the construction and requested to return the initial amount Rs 6.90 lakh to the CHB. He said the CHB deducted 10 per cent of Rs 69,000 and returned the remaining amount.  He said he would not have applied in the scheme had the CHB informed the fact of the encroachment while launching the scheme. Rattan demanded that the deducted amount of Rs 69,000 should be returned with the interest. —TNS
