Chandigarh, March 24

Real estate firm Unitech Ltd’s Chairman and two Managing Directors have been awarded a three-year jail term and Rs 10,000 each as fine for not complying with the order of the UT consumer commission regarding refunding money to an applicant, who was not given the possession of a plot on time.

This is the third time they have been awarded the sentence in the past around two months. Though non-bailable warrants have again been issued against them, these have served little purpose as the police have failed to arrest them and present them before the commission.

In this case, Brig Ajay Raina (retd) and his wife Rajesh Raina, residents of Sector 35, said the commission had, on May 24 last year, ordered that they be refunded Rs 50,16,650 along with interest at the rate of 15 per cent (compounded quarterly). Unitech was also directed to pay Rs 3.50 lakh as compensation to them along with the litigation fee.

They had purchased a plot, measuring area 358.80 sq yards, in Uniworld City, Sector 97, Mohali.  However, despite making the payment, they were not given the possession of the plot.

Thereafter, an execution plea was filed to award punishment to the “judgment debtors” following which Romesh Chandra, Chairman, and Ajay Chandra and Sanjay Chandra, Managing Directors, were awarded the sentence.
