Chandigarh, April 16

Chandigarh-based Government Medical College and Hospital’s action of declaring a doctor-candidate ineligible for admission to an MD/MS course because she had not passed her MBBS examination from Chandigarh came under judicial scanner here on Monday.

Acting on a petition filed by Dr Chahat Bhatia through senior advocate Girish Agnihotri and Arvind Seth, a Division Bench issued a notice of motion to the Government Medical College and Hospital, Sector 32, and other respondents.

The Bench fixed April 18 as the next date of hearing in the case. In her petition, the doctor has sought quashing of a clause in the prospectus for admission to MD/MS courses, wherein the benefit of institutional preference was extended up to 100 per cent of the total seats of the state quota to the candidates passing MBBS from institutions located within the boundary of Chandigarh.

Agnihotri claimed the petitioner was aggrieved by the inaction of the respondents wherein her name was declared ineligible for admission to the courses with remarks that she had not done her MBBS from the GMCH, Chandigarh, despite the fact that the petitioner was having the domicile of Chandigarh.

The Bench was also told that the petitioner did MBBS course from Gian Sagar Medical College and Hospital, Banur, and secured 580 marks in NEET. Her all India rank was 11,063.
