A special CBI court here has acquitted former Haryana DGP MS Malik and two others in a case of alleged irregularities in the recruitment of constables.
The two others are DSP Arun Kumar, who is about to retire, and former DSP Udey Shankar. As the prosecution agency failed to prove the charges, the court acquitted the accused on Saturday.
The CBI had filed a chargesheet against Malik, who is a member of the Indian National Lok Dal (INLD), and the two others, charging them with cheating, criminal conspiracy, forgery and corruption.
On December 13, 2004, the Punjab and Haryana High Court had handed over the case to the CBI. On June 19, 2006, the investigating agency had registered a case at its Chandigarh branch.
The CBI had submitted that in 2003-04, the selection board was formed for 150 posts of constable from the SC category in the Haryana Armed Police (HAP) and 350 posts of temporary constable in the Government Railway Police (GRP). It was formed on Malik’s orders. The selection board comprised then SP (Railways) Ravi Azad, Arun Kumar and Udey Shankar.
Azad had died during the course of investigation.
The CBI had submitted before the court that on July 4, 2004, before the declaration of results, Azad had visited Malik’s house in Chandigarh. There, Malik had handed him a list of candidates for selection as GRP constables.
The investigating agency had informed the court that Azad had even directed his subordinates to take out application forms of certain candidates whose names were dictated by him from the list. The subordinates then arranged the names district-wise.
The CBI had submitted the PET (Physical Efficiency Test) registers were prepared later after adjusting the marks of certain candidates.
The CBI had informed the court Azad had asked his subordinates to put the loose record, the list of eligible candidates found in PET registers and interview marks list in his official car. The records were later set on fire, it had submitted.
