The Supreme Court today ruled that awarding adequate jail term was necessary in road accident cases to check the growing tendency of rash driving and the resultant casualties, besides ensuring overall justice. Sentence should not be substituted with compensation.
The SC also requested lawmakers to enhance the maximum sentence under Section 304A for causing death in road accidents. An SC Bench set aside a Punjab and Haryana High Court judgment reducing the one-year sentence awarded to a convict in a road accident case to 24 days, the period already undergone.
The convict, Saurabh Bakshi, had been awarded one-year jail by Patiala court in 2012 for crashing his vehicle into another car and killing two persons.
