Step towards gender justice: Experts

Legal experts welcomed the Supreme Court’s verdict declaring the practice of triple talaq unconstitutional, saying it was just the beginning towards ensuring gender justice to Muslim women.

“It will go a long way in restoring the human rights of Muslim women in India. This is just the beginning. All such practices based on gender bias have to be stopped,” senior advocate KTS Tulsi said. 

Senior advocate Mukul Rohatgi, who represented the Centre before the top court as the Attorney General, termed it a “path-breaking judgment and a step towards achieving the ultimate goal of a Uniform Civil Code.

He said: “If these personal laws were arbitrary and pernicious traditionally, they must give way to the doctrine of equality and the right to have a dignified life for all citizens. This was the stand of the government which has been completely vindicated.” 

Terming it a “landmark” verdict, Attorney General KK Venugopal complimented his predecessor Rohatgi for presenting the stand of the NDA government in a convincing manner.  OP Jindal Global University Vice-Chancellor and Dean of Jindal Law School Prof C Raj Kumar said: “It’s a historic verdict which was long overdue. It will pave the way for other forms of reforms in all communities in relation to status of women.”

All India Muslim Women Personal Law Board counsel Chandra Rajan said: “It’s a historic verdict for India, particularly, Muslim women who have been discriminated against for centuries.”

Rashtrawadi Muslim Mahila Sangh president Farah Faiz—a lawyer and a petitioner in the case said: “We will be victorious in the true sense only once the law is framed so as to make this practice punishable. There is no remedy for women against the practice till a law is framed.”
