Court raps NRI woman for concealing facts

Chandigarh, May 13

An NRI woman has been rapped by the Punjab and Haryana High Court for trying to overreach the law in a matrimonial dispute case. "The petition is clearly a grave misuse of the process of the court," Justice Bharat Bhushan Parsoon has asserted.

A permanent resident of the USA visiting India occasionally, she wanted petition filed by her husband under the Hindu Marriage Act to be transferred from Pathankot to Bathinda. Claiming that she was residing at Rampura Phul in Bathinda district, she had contended that Pathankot was more than 300 km away. On the other hand, Bathinda was only around 30 km from Rampura Phul. She also claimed that pendency of the petition at Pathankot caused embarrassment and harassment to her.

Contesting the plea, her husband claimed that she was a Green Card holder and staying in Baltimore, Maryland, USA. She was employed in a hospital and occasionally visited India to meet her aged father and younger brothers at Rampura Phul.

Dismissing the plea, Justice Parsoon said her earlier application for transfer was dismissed in November 2012.
