Just about a month after Pathankot Sessions Judge called for a medical examination of an accused to determine his age in the Kathua gang rape and murder case, he has moved the Punjab and Haryana High Court to challenge the order.
Describing himself as juvenile, the petitioner stated the court below, vide impugned ordered dated June 12, passed “illegal directions” for subjecting him to medical test. The court, in the process, ignored original certificates produced before it, which substantially proved his age.
Seeing directions for allowing the revision petition by setting aside the order, the petitioner also prayed for treating him as per the provisions of the Juvenile Justice Law after determination of his age on basis of documents produced.
In his petition against J&K, the petitioner added that he was falsely implicated and arraigned as an accused in the FIR dated January 12 that was registered at the Hiranagar police station in Kathua under the Ranbir Penal Code.
The trial commenced before the court of Pathankot Sessions Judge in accordance with the directions and order dated May 7 passed by the apex court. — TNS
