Faridabad, too, wants house tax relief Faridabad, December 17 Critics have claimed that if implemented, the state would not only have a dual policy on house tax, it would also make the residents of Faridabad pay a higher rate of house tax in comparison to the other districts. “The state government cannot have two policies on one matter,” says Mr Krishan Pal Gurjar, leader of the BJP Legislative Party in the state Assembly and sitting MLA from Mewla Maharajpur. Describing it as discriminatory and unjustified, he said the state government could not deny the concessions to residents of this district, which had been announced in the new policy announced recently. He said Faridabad had been contributing the largest ‘revenue’ and it could not be excluded from the amended house tax rate structure. He announced the convening of a joint meeting of political leaders and representatives of various organisations, including residents’ welfare associations, to discuss the issue and adopt a strategy for opposing the move. He said a joint agitation may be launched soon, if the government did not withdraw this decision. The issue dominated the meeting of the district Congress unit as well and it criticised the state government. The secretary of the Haryana Pradesh Congress Committee (HPCC), Ms Sharda Rathaur, has said that the party would not accept any such decision. While the local INLD leaders and activists are maintaining a silence, workers of other parties, including the Samajwadi Party, Lok Jan Shakti and Janata Dal (U), have also condemned it. Mr Karan Singh Dalal, MLA from Palwal, has also criticised the government and has offered to join any ‘agitation’ on the issue. |
HIGH COURT Chandigarh, December 17 Delivering the verdict on a petition filed by Saroj Kumari, a JBT teacher in Agroha Government Primary School, Mr Justice Kathuria ruled: “Headmaster Chajju Ram, in his complaint, has only stated that he is a Harijan by caste but has not specified whether he is a member of the Scheduled Caste or the Scheduled Tribe.... Harijan as such has not been included in part V of the First Schedule of the Scheduled Caste and Scheduled Tribes (Amendment) Act of 1976 relating to caste deemed to be a Scheduled Caste in the state of Haryana. Therefore, there is a force in the stand taken by the petitioner’s side that since her case is not prima facie brought within the purview of a section of the Act, another section debarring her from claiming anticipatory bail under Section 438 of the Code of Criminal Procedure cannot be pressed into service from the side of the prosecution”. The Judge ordered: “Keeping in view the facts and the position of law, this petition deserves to be accepted. I, therefore, accept this petition and direct that in the event of the arrest of the petitioner on the allegations in the complaint, in pursuance of the summoning order passed by Hisar Judicial Magistrate, she shall be released on bail on her furnishing own bond and that of a surety to the satisfaction of the arresting officer or the court concerned”. In his detailed judgment, Mr Justice Kathuria observed: “The provisions contained in the section relating to the punishment for offence of atrocities does not apply to a person who himself or herself is a member of such a caste or tribe. The net result is that to attract the provisions of the section, the offence punishable must be committed by a non-member of the Scheduled Caste of Scheduled Tribe and in respect of a member of a Scheduled Caste or Scheduled Tribe”.
Commissioner’s
power on relief The High Court has held that a Commissioner, under the Workmen’s Compensation Act, has the jurisdiction to set aside an ex-parte award after being shown sufficient cause to do so. In a significant ruling on a petition filed by two Yamunanagar residents, the court observed: “Counsel appearing on behalf of the petitioners contends that the Commissioner under the Act has no jurisdiction to set aside the previous award of compensation passed by him. In the present case, the award was passed ex parte and therefore the Commissioner under the Act had the jurisdiction to set aside the award on sufficient cause being shown”.
Relax qualifications
for part-timers A Division Bench of the High Court has directed the state of Haryana to relax additional qualifications with regard to two part-time employees, having sufficient experience to their credit, and to consider their case for regularisation. Pronouncing the orders on two petitions filed by Nafe Singh and Om Pati, both part-time water carriers, the Bench, comprising Mr Justice R.L. Anand and Mr Justice Adarsh Kumar Goel, observed: “The grievance of counsel for the petitioners is that Nafe Singh has been working for the past 14 years as a water carrier though part-time, and that Om Pati is also working in the same capacity for the past nine years. They have sufficient experience of serving water to the students and to the teachers of the institution.... Keeping in view all the duties being performed by them, we give directions to the respondents to relax the additional qualifications.... We also clarify that the petitioners will not be granted any retrospective benefits”. |

Chandigarh, December 17 The mission is headed by the Principal Secretary to the Chief Minister, Mr S.Y. Quraishi. The first group will prepare the overall sectoral scenario of Haryana. Headed by the Financial Commissioner and Secretary, Labour and Employment, Mr Prem Prashant, it will submit its report within three months. There will be a sectoral group each for agriculture, the rural non-farm sector, transport and tourism, the service sector, industry and training and human resources development. It has also been decided that each of the 20 member departments of the HEM will quickly prepare a situation report on what they are doing on employment generation, what they can do to increase the job opportunities, what they expect the other departments to do and what their efforts are likely to achieve. The mission will also identify all jobs in the organised sector in the state for which employers are finding it difficult to hire suitable personnel. A skill profile for all such jobs will be prepared by the Department of Employment so that a skill-job matching exercise can be undertaken. It will also identify all its allies, non-government organisations working on the subject and private placement agencies and develop linkages with them for synergetic action. |
Cong should review decision on POTO: Bitta Ambala, December 17 Talking to mediapersons, he said that the decision of the Congress to oppose POTO would have been against the wishes of late Congress leaders Indira Gandhi and Rajiv Gandhi. He said he would continue his fight against terrorism even if he had to pay a heavy price for it in the party. He urged the Congress high command to review its decision regarding POTO. He said the high command had opposed POTO without taking the party cadre into confidence and they would not accept it. He said it was unfortunate that the Congress and the Panthic Committee had been expressing similar views over POTO. Mr Bitta said the recent terrorist attack on Parliament was the biggest act of terrorism in the country. It could have take a serious shape if the security personnel on duty did not encounter the terrorist who had the plan to enter Parliament. He said the attack was made when the Bill against terrorism was to be discussed in Parliament. He said all political parties should jointly start a campaign against terrorism. He appreciated film actress Shabana Azmi for opposing terrorism. He urged the Muslim leaders of various political parties to oppose terrorism. He said it was unfortunate that some leaders holding the ministerial berths hesitate to oppose terrorism. Allaying fears on POTO, he said it was weaker than TADA. The government should come up with some Act stronger than POTO, which could end terrorism in the country. He demanded that anti-terrorist courts should be under the Army control. He demanded that persons like Mr K.P.S. Gill or Mr Jagmohan should be appointed Governor of J and K to fight the terrorism effectively. The Chief Minister of J and K passed most his time in Delhi. In this situation how could he deal with terrorism? he asked. Mr Bitta said it is the appropriate time to declare war against terrorism. He said the Army should not hesitate to attack the terrorist camps working in PoK. India should also start a proxy war against Pakistan, he added. |

on Punjabi culture from today Kurukshetra, December 17 Mr R.S. Chaudhry, Vice-Chancellor, Kurukshetra University, will inaugurate the seminar tomorrow at 11 a.m. in the senate hall of the university. Harbhajan Singh Halwarvi, Editor of Punjabi Tribune, will preside over the function. Dr A.S. Kaang, Chairman of the Department of Punjabi, Kurukshetra University, is the Director of the seminar and Prof S.S. Noor of the Delhi University will present the keynote address at the seminar titled “Globalisation: Impact on the Punjabi Literature and Culture”. Dr Kaang briefed the press about the paper writers of the seminar. Balwant, Dr Rawal Singh and Dr Narvinder Singh Kaushal were invited in the capacity of prominent thinkers of the thrust area. He said Prof Darshan Singh, Dr Gurbhagat Singh, Prof N.K. Oberoi, Prof Davinder Singh Jammu, Dr Variam Singh Sandhu, Dr Surjit Pattar, Dr Noor and Dr Gulzar Singh Sandhu would preside over the various sessions of the seminar. The writers coming from abroad were Swaran Chandan (England), Sukhinder (Canada), Dev (Switzerland) and Hajvinder (German). Apart from them, many NRIs would participate in the seminar as delegates, he said. |
Review textbooks with changing time: Director Kurukshetra, December 17 Mr Rajput added that the NCERT had many responsibilities and it had to coordinate with various institutions in this regard. So its role should not be doubted. “In fact, our aim is to provide such an education that develops spirit of patriotism and right ideology”, he added. In reply to a question regarding the reviewing of history books, Mr Rajput said the NCERT would do everything according to the education policy. He further said syllabus was being framed in such a manner that it would lessen the unnecessary burden on students. |
