Reliance moves HC against airport bidding

Reliance Airport Development Ltd, a company owned by Anil Ambani, today moved the Delhi High Court seeking quashing of the entire tender process terming it as “mala fide”.

Raising two important issues —whether the government could change the terms and parameters of evaluation and award of tenders hours before the final stage of the opening of bids without reason or notice and whether the tender could be given to a bidder who had offered lower revenue sharing — the Reliance Airport Development Ltd (RADL) has sought a direction to the Centre to withdraw or cancel the bidding process.

If the government did not agree to withdraw or cancel it, then it should be set aside by a judicial verdict as the Centre had acted in “arbitrary and discriminatory” manner in awarding the contracts to GMR Industries Ltd and GVK Industries Ltd for Delhi and Mumbai airports, respectively, the petition said.

Also accusing the government of acting in a “mala fide” manner, Reliance, in its second plea sought the awarding of contract of Delhi airport to it as it was legally entitled to it for being the highest bidder. The company also sought a direction to issue a Letter of Intent to it in respect of Mumbai airport by giving it an opportunity to match the highest bid.

While RADL had offered revenue sharing of 45.99 per cent to the Airport Authority of India (AAI), the GMR which got the contract for Delhi airport, had only quoted it at 43.64 per cent, the petition said.

“The Union Government and the AAI have awarded the tender to GMR and GVK. But as per the terms of the tender, the highest financial bid was the sole criteria for awarding of the contract for each airport,” Reliance said in its petition.
