HC summons Ludhiana DC

Coming down heavily on the Ludhiana Administration for “not putting the house in order” in the Buddah nullah matter, a Division Bench of the Punjab and Haryana High Court today directed the Ludhiana deputy commissioner and the municipal commissioner to be present in the court along with the managing director of the Punjab Water Supply and Sewerage Board, the member secretary of the Punjab Pollution Control Board, the chief town planner and the district town planner.

The Bench comprising Chief Justice Vijender Jain and Justice Ranjit Singh also directed the Ludhiana sub divisional magistrate, dealing with encroachments, to be present in the court. The case will now come up for further hearing on December 17.

In its detailed order, the Bench observed: “We find that the administration — the deputy commissioner, the municipal commissioner and Punjab Pollution Control Board — have not put their house in order. The removal of garbage by the municipal corporation, Ludhiana, is at a very slow pace…. It appears that the local administration, as well as various agencies of the state involved in clearing the Buddah nullah, is not taking prompt action.”

It observed: “We have been told by A.K. Takkar, advocate for the Pollution Control Board, that encroachments existing on both sides of the Buddah nullah are yet to be removed. Senior deputy advocate-general A.G. Masih says notices under the Punjab Premises Act have already been served upon the encroachers and the SDM, Ludhiana, is dealing with the cases of encroachments.

The Bench added: “We direct, the SDM, Ludhiana, dealing with the cases of such encroachments of the nullah to be present in the court on the next date of hearing.”
