SC stays order against Islamabad HC

The Supreme Court on Monday struck down an order of the Lahore High Court staying the establishment of the Islamabad High Court and forbade it from hearing the matter anymore. A three-member Bench of the high court had stayed the formation of the federal court under a constitutional amendment introduced by President Pervez Musharraf on the eve of the lifting of the emergency on December 15. The Supreme Court heard attorney- general Qayyum Malik briefly and struck down the high court order.

Pleading for suspending the Lahore High Court order, Qayyum said the provincial court had no jurisdiction to suspend the constitutional amendment made by the President during emergency proclamation.

He said the apex court had upheld the emergency measures, including the setting up of the Islamabad High Court.

The 4-member apex court Bench will now hear the matter in January.
