Haryana housing federation fined for unfair trade practices
Tribune News Service

Panchkula, September 3
The Panchkula District Consumer Disputes Redressal Forum has directed the Haryana State Co-operative Housing Federation to pay to the complainant a sum of Rs 20,000 as compensation for mental agony, harassment and inconvenience caused to the complainant as also on account of deficiency in their services and indulging in unfair trade practices here today.

The forum has also asked them to pay Rs 5,000 as costs of proceedings to the complainant. The complainant, Ami Chand, a resident of Naraingarh, Ambala district, in his application stated that 25 years ago in 1986, he had applied for a loan of Rs 75,000 from Shiv Co-operative House Building Society, Naraingarh.

According to the complainant, only a sum of Rs 22,500 as a loan was sanctioned in his favour although the mortgage deed and agreement deed talked of a loan amount to the tune of Rs 75,000. He further alleged that interest on the amount of Rs 75,000 was charged from him instead of charging the interest on the amount of sanctioned loan of Rs 22,500 only.

However, the Haryana State Co-operative Housing Federation had issued several notices to the complainant for the recovery of Rs 3,54,227, which were arbitrary and illegal, claimed the complainant.

In their reply opposite parties stated that the complainant had applied for a loan and that he had received Rs 75,000, and interest was chargeable on the entire amount of Rs 75,000.

“We are of the view that there is a gross deficiency in the service on the part of the Haryana State Co-operative Housing Federation and they have indulged in unfair trade practices for harassing the complainant unnecessarily, issuing him false and frivolous notices of recovery and preparing sales case against him on false and frivolous grounds, thus causing him mental agony and financial losses,” said the forum comprising president Ashok Kumar Jain and members Sarita Jain and SP Singh.

“Therefore, we allow the complaint of the complainant and direct the federation to treat the amount of loan advanced to the complainant on January 9, 1987 to be Rs 22,500 and to recalculate the amount repayable by the complainant or refunded to the complainant as the case may be, by treating the rate of interest (simple) at current rate, 10 per cent per annum, thereon,” directed the forum.

“The amount already recovered from the complainant to the tune of Rs 53,000 should also be taken into consideration and accordingly after recalculating the amount in the manner directed by us, if the complainant is found to have paid the amount of loan in excess, then the excess amount paid by him be refunded to him forthwith and in case it is found that the complainant has paid less amount, then the Housing Federation is at liberty to recover the same,” the forum stated.

Charges framed against accused
Tribune News Service

Panchkula, September 3
In the Simran murder case, District and Sessions Judge Manjit Singh today framed murder charges against her ex-lover Tanmay. The police had recently filed a chargesheet against Tanmay in the Panchkula district court. Simran was a student of International Institute of Fashion Design and was staying in Sector 15 here.

Tanmay, the accused, had reached Simran’s residence on April 30 in Panchkula, where he found her in the company of three youths whom he did not know, the police said. After they left, Tanmay started questioning the victim about the youths, sources said.

In a fit of rage, he allegedly attacked her and hit her head against the bathroom wall and subsequently strangulated her, the sources added. Later, he allegedly dumped her body in a vacant plot near Lidhran village on the Jalandhar-Amritsar national highway.

Tanmay then surrendered before the Panchkula police on the night of May 13.

Simran, who belonged to Amritsar, had been living in Sector 15 from 2010. In 2004, she married Karan, but got divorced on April 26 this year. Cops had found Simran's car abandoned in the Sector 16 market, Panchkula, on May 1. They came to know about her Amritsar address from the documents that were found in the car.

It was on her father’s complaint that the Panchkula police had lodged a missing person’s complaint at the Sector 15 police post in Panchkula. But after recovering her body, cops had converted the missing complaint into a murder case and registered a case against her ex-husband Karan Mehra and her close friend, Tanmay, under Sections 302 (murder), 364 (kidnapping) and 201 (causing disappearance of evidence of offence) of the IPC. But during investigations, the police gave a clean chit to Karan Mehra.
