Advocate’s legal notice to Assembly Secretary

A local advocate has issued a legal notice to Secretary, Haryana Assembly, for allegedly causing a loss of Rs 48.14 lakh to the state exchequer by paying income tax on the salary of legislators out of the state exchequer.

GD Gupta, advocate district bar, Jagadhri, issued a legal notice to RK Nandal on Saturday.

He asked him to give reason as to why a criminal complaint under Sections 166, 167 and other relevant sections of the IPC should not be filed against him.

“By violating provisions of the Haryana Legislative Assembly (salary allowances and pension of members) Act, 1975, he had caused a loss to the state exchequer and since the money goes to the state exchequer through the taxes paid by the general public, he has caused injury to the public in general and he, being a public man also, feels injured,” said Gupta.

Gupta also asked Nandal that in his own interest, he should recover the amount of Rs 48.14 lakh along with interest from the members responsible, otherwise he was liable to recoup the loss of the government.
