Bihar native gets life term for rape, murder of student
The court has also imposed a fine of Rs 50,000 on the convict
A Fast Track Special Court on Monday sentenced one Mohd Sakir (25), a resident of Madhubani in Bihar, to undergo life imprisonment in a rape and murder case of a girl student. The court has also imposed a fine of Rs 50,000 on the convict.
A case was registered on the complaint of the girl’s mother on November 20, 2022 after her body was brought to the Civil Hospital, Sector 45, Chandigarh. As per the complainant, she, along with her family, including a son and a daughter, used to reside in a rented accommodation at Burail village.
On the day of incident, she went to work after dropping her son, a Class VI student, at school. At that time her daughter, a Class XII student, was alone at home. When the woman returned, she found the door of the room open and her daughter lying on the bed.
As the girl was unconscious, the mother panicked and called her landlord. With the help of others, she took her daughter to hospital, where doctors declared her brought dead.
The body bore scratch marks with blood coming out of her right ear. She suspected that Mohd Sakir, who previously used to reside in the adjoining room, had committed the crime.
The complainant further stated that Mohd Sakir used to meet her daughter in her absence and when she came to know about it, she warned him against talking to the girl. Her landlady informed the woman that Mohd Sakir had come to meet the girl in the room. On checking CCTV footage, it was revealed that he did enter the room around 9.30 am and remained there for about an hour.
The complainant said she was sure that Mohd Sakir had killed her daughter.
During the investigation the police arrested the accused.
Finding prima facie case, charges were framed against the accused, to which he pleaded not guilty and claimed trial.
Ritu Kumari, counsel for the accused, argued that he is falsely implicated in the matter. No direct injuries were attributed to the accused at the time of medical examination of the deceased, she added.
As per the CCTV footage, the accused entered the room around 9.30 am and left after about an hour, whereas the post mortem report is silent about the time of the girl’s death, the counsel said.
Neighbour did not hear the noise or cries of the girl, the counsel said, adding that there are no allegations of rape in the FIR.
The public prosecutor argued that the prosecution has proved the case beyond a shadow of doubt.
He said CFSL reports supported the case of the prosecution.
After hearing of the arguments the court convicted the accused and sent him to life imprisonment.
