CHANDIGARH: A local court has acquitted a resident of Kangra in a cheque bounce case of Rs 20 lakh.

A local court has acquitted a resident of Kangra in a cheque bounce case of Rs 20 lakh.

In a complaint, Satnam Sing, a resident of Gurdaspur, mentioned that Tajveer Singh, a resident of Kangra, had mortgaged his property and executed an agreement on August 22, 2012, and received Rs 20 lakh from him against the agreement.

In order to discharge his legal liability, Tajveer issued four cheques amounting to Rs 5 lakh each and all cheques were drawn on Punjab National Bank. The complainant presented the cheques dated August 22, 2013, before the bank for encashment, but the banker of the accused dishonoured the same with remarks “insufficient funds”.

The cheques were again presented by the complainant, but the banker of the accused again dishonoured the same. Thereafter, on January 23, 2014, a legal notice was sent to the accused, but still the latter did not make the payment.

After hearing the arguments, the court observed that complainant had alleged that he had paid Rs 20 lakh in one single installment and that too in cash. No explanation has been put forth as to what was the source of this substantial amount of Rs 20 lakh. It was also stated that neither any bank statement that the cash was withdrawn from it nor any document of business dealing in lieu of which it was received was placed on record.

He merely stated that he had this amount with him because of a property deal. He did not show the property deal in his ITR or in any bank. He did not remember the name of the person with whom this property deal has taken place.

He further stated that he had received Rs 20 lakh by selling property of someone else. He said he did not remember the exact deal in which he had received this amount. This amount had accumulated in one to two years’ time. It is apparent that the complainant has failed to lead any cogent and evidence to prove his financial capacity to lend such a heavy amount to the accused person. Hence, the court acquitted the accused.
