Tribunal orders Rs 18 lakh to be paid to family of man killed in road mishap
The accident took place due to the negligence of the car driver, the deceased’s wife claimed
The Motor Accident Claims Tribunal, Chandigarh, has directed the insurance company, the driver and the owner of a car to pay a compensation of Rs 18.34 lakh to the wife and children of Kuldeep Singh, who died in a road accident nine years ago.
Seema Devi, resident of a village in Ambala, in the claim petition filed under the Motor Vehicles Act, said that on April 18, 2016, her husband who was driving a car was hit by a rashly driven car and later succumbed to his injuries. The accident took place due to the negligence of the car driver, she claimed.
She said her husband was 28 at the time and ran a canteen at a factory and a dairy in the village and earned around Rs 30,000 a month. He was the sole breadwinner of the family, she said.
As the driver and owner of the car failed to appear in the court, they were proceeded against ex parte. The insurance company resisted the claim plea on the grounds that the driver did not have a driving licence.
After hearing the arguments, the tribunal held that all respondents were liable to pay the compensation.
