Builder fined for failing to give possession of flats

PANCHKULA: The District Consumer Dispute Redressal Forum has slapped a fine of Rs 1.05 lakh on Hanumanta Promoters, a real estate company, for its failure to provide possession of flats within one year to three consumers even after two years of booking.

The District Consumer Dispute Redressal Forum has slapped a fine of Rs 1.05 lakh on Hanumanta Promoters, a real estate company, for its failure to provide possession of flats within one year to three consumers even after two years of booking.

The three consumers — Hardeep Singh of Sector 20, Chandigarh, Gurdeep Kaur of Palsora and Muni Lal Punjab of Kharar — in their complaint to the forum had stated that they had decided to book a flat in Micro Homes Project at Jhandpur village near Kharar. They said they visited the office of Hanumanta Promoters as they were dealing with the project. They said they took the details of the project and the promoters told them that the possession of the flat would be provided within one year of the booking.

The promoters further told them that the company had taken the approval of residential project, besides taking clearance from the PUDA, Town Country Planning and the Municipal Committee. They further said work on the project had already been started.

The consumers said they had deposited Rs 13 lakh each and after the promoters told them that if they failed to give the possession of the flat to them then the company would refund them the booking amount, along with the interest. The promoters had also assured them that after depositing the booking amount a formal letter would also be given to them within a week.

They further said due to delay in the construction of the flat they were suffering huge losses and after this they had sent a notice to the company on September 10, 2017, for refunding their booking amount, along with the interest. But the company did not respond to the notices, thus forcing them to file a complaint in the consumer forum.

The forum headed by President Satpal directed the builder to refund Rs 13 lakh taken from each of the consumer, along with 9 per cent interest. It also directed the company to pay Rs 35,000 each to the three consumers for physical and mental agony caused to them.
