Panchkula court rejects plea of accused cops for discharge

A Panchkula court has rejected the submissions of the accused Haryana Police officials for discharge, who are facing court proceedings for fabricating evidence in a case related to the murder of a 7-year-old student of Ryan International School, Gurugram.

The CBI had filed a chargesheet in 2021, accusing four police personnel of torturing the school bus conductor Ashok Kumar and giving him “electric shocks” to extract his confession for the murder, though a senior student was involved.

The CBI says that DSP Birem Singh, Inspectors Narinder Khatana and Shamsher Singh (then a Sub-Inspector), and Exemptee Sub-Inspector Subhash Chand knowingly fabricated “false evidence”, prepared “incorrect” documents, and pressured witnesses to implicate the conductor for the murder of the boy and “screen” the real offender. The conductor told the CBI that the police personnel tortured him, gave him electric shocks and injections, and threatened to kill him in an encounter.

In a recent order, the CBI Special Court, Panchkula, said the “submissions raised on behalf of accused persons seeking their discharge have been rejected.”

It added that a prima facie case for commission of offences punishable under various Sections of the IPC and substantive offences thereof is made out against the accused persons, and as such, they were “liable to be charge-sheeted thereunder.”

The next date in the case is fixed for December 9 for the framing of the chargesheet.
