Police to pay for not complying with order

The Palwal police and district administration have been caught on the wrong foot over compliance with a court order.

The district court has ordered the police to pay Rs 20,500 through demand draft to the father-in-law of a decree holder in the wake of non-compliance with its order of recovery of interim maintenance.

The court of Additional District and Sessions Judge Anubhav Sharma directed the district police to ensure the release of a demand draft for Rs 20,500 to Mahavir, who had been coerced into paying the amount of interim compensation to Pinki.

The Palwal SP was asked to ensure compliance with the order along with a letter of apology from the Chandhut SHO.

The execution petition was filed on March 18, 2016, in which Pinki had sought interim maintenance from her husband Shish Ram, who was liable to pay Rs 20,500.

Having failed to ensure presence of Shish Ram, conditional warrants of his arrest had been issued, which were received as non-executed on various occasions.

In the wake of failure of the police in executing the conditional warrants, the court on July 31, 2018, imposed on the state government the liability of paying the compensation.

A copy of the order was forwarded for compliance to the Palwal Deputy Commissioner. On September 24, Head Constable Anil at the Chandhut police station submitted a demand draft for Rs 20,500.

Applicant Mahavir, father-in-law of the decree holder, filed an affidavit that the amount which was required to be paid by the state had been forced upon him.

“The highhandedness of the police is apparent from the proceedings recorded above,” read an order passed on October 16.

Giving the police a word of caution, it ordered that the demand draft be released to Mahavir within 15 days after due recovery.
