Israel dredged up the brutal and chilling Hamas attack of October 7 to justify before the International Court of Justice (ICJ) its bombing and ground operations in the blockaded enclave of Gaza since then.

South African lawyers on Thursday had asked the ICJ to order an immediate halt to Israeli military operations in Gaza but even an interim order of this kind is likely to take weeks. As the US has put its diplomatic weight behind Israel, any final decision on the case will take several years, according to reports.

“This is no genocide,” said Israeli lawyer Malcolm Shaw while rejecting all accusations made by South Africa about a state-led genocide campaign against the Palestinians as false and grossly distorted. Israel said it was actually defending itself by fighting Hamas, and not the Palestinian population.

“The appalling suffering of civilians, both Israeli and Palestinian, is first and foremost the result of Hamas’ strategy. If there were acts of genocide, they have been perpetrated against Israel. Hamas seeks genocide against Israel,” said Tal Becker, another lawyer engaged by Israel. South Africa had said Israel’s attacks had converted much of the enclave into rubble and killed nearly 24,000 people with the aim of bringing about the “destruction of the population” of Gaza.
