SC asks Mamata, others to approach Calcutta HC for SIR grievances

CJI-led Bench notes SIR exercise conducted smoothly across country, except in West Bengal

The Supreme Court on Tuesday asked West Bengal Chief Minister Mamata Banerjee and other petitioners to approach the Calcutta High Court Chief Justice with their grievances pertaining to the ongoing special intensive revision (SIR) of electoral rolls in the state, where the Assembly elections are due next month.The direction came from a Bench led by Chief Justice of India Surya Kant, which noted that the SIR exercise had been conducted smoothly across the country, except in West Bengal.

Senior advocate Shyam Divan, on behalf of the Chief Minister, flagged issues relating to timelines. Noting that electoral rolls were required to be frozen seven days prior to polling, he submitted that several candidates whose names were under adjudication may not be able to file nominations within stipulated deadlines.

As Divan pointed out that the March 10 order of the court laid down a framework for handling claims and objections arising from the revision process, the top court asked the petitioners to approach the Calcutta High Court Chief Justice as most of the issues raised were administrative in nature.

SC junks PIL seeking inclusion of denotified tribes in Census.

The Supreme Court on Tuesday refused to entertain a PIL seeking directions to include the Denotified Nomadic Tribes as a distinct category in the upcoming national Census.

Noting that such classifications fell within the domain of government policy and were “not justiciable”, a Bench led by CJI Surya Kant disposed of a petition filed by one Dakxinkumar Bajrange.

The Bench, however, allowed the petitioner to make a representation to the Registrar General and Census Commissioner of India.

The PIL had sought a mandate for the Census Commissioner to ensure that members of denotified nomadic tribes were specifically identified during the population enumeration of the Census.
