Taking note of the non-compliance of orders about registration of title deed of a plot allotted to complainant Sham Singh, the Punjab State Consumer Disputes Redressal Commission has issued bailable warrants against the Ludhiana Improvement Trust (LIT) Chairman for the adjourned date (July 23, 2020).

Taking up the revision petition, filed by the complainant against non-compliance by the respondent (LIT) on July 7, the president of the Commission, Justice Paramjit Singh Dhaliwal, disagreed with the contention of the counsel for respondent that the Vigilance Department had prohibited the respondent from execution of sale deed.

“The Vigilance authority cannot be over and above the orders passed by the Hon’ble National Commission, this Commission and the District Forum. This is a lame excuse. The matter is pending before District Forum since 2009 and more than 11 years have already elapsed that the orders have not been executed on one pretext or the other,” noted the Commission.

Justice Dhaliwal further pointed out that it was specifically mentioned in the order dated June 23 that in case the said order was not complied with, the Chairman and the Executive Officer (of LIT) should be present on the next date, but only latter appeared.

“Today, it has been stated that the order has not been complied with and the learned counsel for respondent prays for more time. Since neither the order has been complied with nor has the Chairman come, hence bailable warrants in the sum of Rs25,000 be issued against the LITChairman to the Commissioner of Police Ludhiana for the adjourned date,” said the orders.

The commission stated: “In the interest of justice, 15 days’ time is granted to the respondent to comply with the order. It is made clear that if the order is not complied with, then appropriate orders will be passed on the adjourned date. No adjournment shall be granted.”
