Chandigarh, July 30

Issuing a notice of motion to the National Commission for Scheduled Castes (NCSC), the Punjab and Haryana High Court today stayed the operation of recommendation/order passed by it in a service matter. Among other things, petitioner Punjab Water Supply and Sewerage Board was directed by the commission, vide the impugned order, to upgrade ‘average’ grading of an employee’s Annual Confidential Report (ACR)/Annual Performance Assessment Report (APAR).

As the petition filed by the board against the commission came up for hearing before Justice Alka Sarin’s Bench, petitioner’s counsel Vijay Kumar Kaushal contended that the impugned recommendation or order passed by the commission dated July 13 was wholly without jurisdiction.

On this ground alone, the writ petition was liable to succeed. Taking a note of the submissions, Justice Sarin fixed the case for further hearing on November 16. — TNS
