Consumer Courts
HUDA penalised for delay
Tribune News Service

CHANDIGARH, Aug 4 — The UT Consumer Disputes Redressal Forum-I has penalised HUDA for non-delivery of an allotted plot for over eight years.

The complainant, Mrs Kiran Bhatia, has in her complaint stated that she had applied for allotment of a plot on June 28, 1989, by depositing a sum of Rs 5, 967 as earnest money, under a scheme floated by HUDA for allotment of residential plots to general public in the Urban Estate of Kurukshetra. In the draw of lots, she was successful and a plot measuring 144 sq mts was allotted to her vide letter dated December 6, 1989.

She has further stated that she deposited the balance amount in annual installments. She thus deposited Rs 59,677 towards the price of the plot. She alleged that she has approached HUDA for getting physical possession of the plot, but the same has not been given even though eight years have elapsed since its allotment.

In its reply, HUDA has stated that the possession of the plot could not be given as the zonal plan of the sector could not be approved due to some technical difficulty and some litigation was also going on in that sector. They further stated that the zoning plan was finally approved on May 7, 1997, and thereafter the possession was offered to the complainant.

However, the complainant contended that the possession was offered on June 30, 1997, after the filing of the complaint in the Forum. During the pendency of the complaint, HUDA on their own refunded Rs 53,452 vide cheque dated October 22, 1997, after illegally and arbitrarily deducting 10 per cent of the total amount of the plot.

The Forum bench comprising its President, Dr H.C Modi, and members, Dr R.K Behl and Ms Shashi Kanta, held HUDA guilty of deficiency in services for it had not offered the possession of the plot for eight long years and deduction of 10 per cent from the amount deposited. They directed HUDA to refund her a sum of Rs 6,225 with interest at the rate of 15 per cent from the date of withholding the said amount till its payment. A sum of Rs 5,000 was awarded as compensation and costs.

Finance company

The UT Consumer Disputes Redressal Forum has penalised a Delhi- based finance company for its failure to pay back the deposited amount to a depositor on the date of maturity.

In her complaint, Mrs Bimla Devi had stated that she had deposited Rs 20,000 with GNG Investment on December 26, 1996. She alleged that the investment company had issued a post-dated cheque for Rs 24,600 on account of the deposited amount and the interest accrued thereon. However, the said cheque was dishonoured when presented on account of insufficient funds.

Notice was issued to the opposite party, but since no one appeared the case was proceeded against ex-parte.

After going through the records, the Foum bench comprising its President, Dr H.C Modi, and members, Dr R.K Behl and Ms Shashi Kanta, observed that the complainant was to get Rs 24,600 on December 26, 1997, in lieu of the deposit of Rs 20,000 made by her in December 26, 1996. But since the said cheque stood dishonoured the money which was to be refunded remained with them. Hence, the complainant stood deprived of the use of that money.

The Foum directed the company to pay the complainant Rs 24,600 along with interest at the rate of 12 per cent per annum with effect from December 12, 1997 till the date of repayment. A sum of Rs 500 were also awarded as costs to the complainant.Back
