High Court
Order to Haryana on JBT teachers’ vacancies
By Our Legal Correspondent

CHANDIGARH, Nov 29 — On two writ petitions challenging the advertisment dated November 15,1999 inviting applications for 3206 vacancies of JBT teachers, a Division Bench of the Punjab and Haryana High Court today directed the District Education Officers (Primary) of Haryana to accept the application forms from BA, B.Ed. candidates as well and interview them provisionally. It issued notice of motion for March 29.

After hearing counsel for Mr Rakesh Kumar and other petitioners, the Bench, comprising Mr Justice H.S. Bedi and Mr Justice J.S. Khehar, ordered that the interim order would be subject to the result of the writ petition.

In the impugned notification it was stated that the preference would be given to those candidates who had done matric and JBT. In case such candidates are not available, those with BA, B.Ed. qualifications should also be considered.

The petitioners alleged that the DPEOs of various districts were not accepting application forms from those candidates, who had done BA and B.Ed.

The advertisement was challenged on the ground that preference to matric and JBT qualification, as mentioned in the advertisement, was arbitrary against the public policy of having best available teachers and was violative of Article 14 of the Constitution as it discriminated against candidates who had done BA and B.Ed.

Notice to centre on book

On a petition for staying the publication of the new edition of the book or reprint of "Medieval India", a history textbook for Class XI prescribed by the CBSE as it contained the alleged derogatry remarks against the Sikh Gurus, filed by Guru Nanak Universal Brotherhood Society, the High Court issued notice regarding stay to the Union of India and others.

Mr Justice V.K. Jhanji, before whom the application for stay came up for hearing, issued the notice for December 13.

The petitioner said Sikhs were aggrieved by a paragraph pertaining to Guru Tegh Bahadur, the Ninth Guru. The conflict between the Sikh Guru and the Mughal ruler had been described as personal and political rather than religious.

Counsel for the petitioner referred to the remarks of Mr Arun Shourie, a prominent scholar, now a Union Minister, in his book "Eminent Historians — There Technology, Their Line, Their Fraud" (1988). Mr Shourie had devoted one full chapter to the above said book and specially pointed out that the history has been distorted in the book.

The petitioner alleged that they would not allow their history to be converted into fiction by the official historian of NCERT.

Notice on plea to quash FIR

Mr Justice K.S. Kumaran issued notice on a petition for quashing F.I.R. registered at Sardulgarh police station in Mansa district against Dr Promila and her husband, Mr Prithi Chand, for carrying out an abortion on a Scheduled Caste girl allegedly without her consent. It was alleged that the girl was raped by one Ram Kumar.

After some days the girl came to the clinic of the petitioners and got her operated for abortion but after the operation the bleading and pain did not stop and injury did not heal. The police registered a case against the doctor and put up challan under Section 3, 4 of Scheduled Castes and Scheduled Tribes Prevention of Atrocities Act, 1989.

Counsel for the petitioner submitted that there was no ground to rope them in the case under the above mentioned Act since at the time of operation they did not know that the girl belonged to the Scheduled Caste. It was contended that to hold them guilty under the Act there should be material to show that they knew about her being from the Scheduled Caste. Secondly, it was stated that the relative accompanying the girl had signed a paper giving consent for the operation.

Notice to Punjab on leave encashment cut

The case came up before the Chief Justice and Mr Justice V.K. Bali.

The petitioner submitted that the Punjab Government instructions dated January 24, 1988, who retired after January 1, 1986, were allowed leave encashment up to 300 days. But those retiring earlier to that were allowed encashment up to 240 days.Back
