Haryana cut in quota for judges stayed

CHANDIGARH, Feb 22 — A Division Bench of the Punjab and Haryana High Court today stayed the operation of notification issued by the Haryana Government reducing the quota of direct recruits in the Superior Judicial Service appointments (to the rank of Additional District and Sessions Judges) in the state.

The Haryana Government had, vide notification dated March 6, 1991, reduced the quota of direct recruits from 33 p.c. to 25 p.c. Again by a notification dated September 19, 1997, this quota was further reduced from 25 p.c. to 15 p.c.

In the writ petition-filed by three practising HC advocates, Dr Attar Singh Kalkal, Ram Avtar Sheoran and Mrs Adarsh Paul Kaur Rana, the two notifications issued by the Haryana Government were challenged on the ground that the state government could not alter the ration for making appointments to the Superior Judicial Service without consultation and consent of the High Court because the state government's powers to frame rules under Article 309 of the Constitution were subject to the provisions of Chapter VI, Part VI, of the Constitution.

It was submitted by the petitioners that the state government had issued the impugned notifications without holding consultation with the High Court. The petitioners had also submitted that the quota for appointment to the Superior Judicial Service should be in tune with the quota fixed for appointment of High Court Judges and had prayed for fixing a quota of 40 p.c. for direct recruits.

In their written statement, the state government had taken a stand that the proposal to reduce the percentage of direct recruits was sent to the High Court but it had not agreed with the proposal. It was submitted by the state that "consultation" did not mean "concurrence".

In the written statement filed by the Punjab and Haryana High Court through its Registrar, it was submitted that the state government had not consulted the High Court before issuing the impugned notification.

The Division Bench comprising Mr Justice V.K. Jhanji and Mr Justice Amar Dutt Sharma admitted the writ petition for hearing by a Division Bench and stayed operation of the impugned notification.

19 Haryana blocks declared backward

CHANDIGARH, Feb 22 — The Haryana Cabinet today took a number of decisions to accelerate the pace of development of industry in the state.

Most of the decisions taken by a Cabinet meeting presided over by the Chief Minister, Mr Bansi Lal, amounted to amendments of its industrial policy announced on August 1, 1997.

The Cabinet, which also decided the excise policy for the next year, withheld its announcement until tomorrow.

It has now been decided to extend the benefit of sales tax deferment on expansion or diversification of the units. As per the amendment, in the high potential zone, the benefit of sales tax deferment will be 100 per cent of the fixed capital investment for small units and 75 per cent of fixed capital investment for medium and large scale units with a time limit of five years. Similarly, in medium potential zone, it would be 125 per cent for small scale units and 100 per cent for medium and large scale units with a time limit of seven years. In low potential zone, it would be 150 per cent for small scale units and 125 per cent for medium scale and large scale units with a time limit of seven years.

The benefit of sales tax deferment on expansion or diversification will be made applicable with effect from July 31, 1997.

The Cabinet also decided to include 19 blocks in 10 districts in the list of backward areas so as to encourage the development of industry in these areas. These blocks are Jind and Julana in Jind, Dadri-II, Bhiwani and Kairu in Bhiwani district. Sirsa and Nathusari-Chopta in Sirsa district, Jathusana in Rewari district, Kaithal and Kalayat in Kaithal district, Sahajadpur in Ambala district, Pehowa and Babain in Kurukshetra district, Karnal and Gharaunda in Karnal district, Meham in Rohtak district and Tohana, Ratia and Bhuna in Fatehabad district. Now 99 blocks would be covered under backward areas out of a total of 112 blocks in the state.

The Cabinet also decided that industrial units which had taken effective steps with regard to land, building and machinery would be given the benefit of sales tax exemption or deferment under the old policy. Such units should have purchased land for the project or taken on lease or rent. Fifty per cent of the cost of civil works of the approved plan of the building should have been completed and paid by July 31, 1997. The industrial units would be required to furnish approved plan of the building in case the unit is located in the controlled area as defined by the Department of Town and Country Planning. In case the unit is located outside the controlled area, a plan approved by the approved architect should be submitted.

Besides, 50 per cent of the machinery should have been booked by placing confirmed orders with at least 10 per cent amount paid as advance as on March 31, 1998. To get benefit under the old industrial policy of 1992, all these above-mentioned conditions should be fulfilled. In case any one of these conditions is not met with, the industrial unit would be given the benefit of incentives as per the new industrial policy of 1997.

The Cabinet also decided to include a provision in the industrial policy so as to ensure that the industrial units provide employment to persons of Haryana domicile. The industrial units which avails of the incentives of sales-tax exemption or deferment in the scheme will have to employ at least 75 per cent of the unskilled work force and give preference to other categories of candidates from amongst the Haryana domiciles. The above mentioned employment percentage will have to be maintained by the industrial units during the period of availment of such incentives. If the unit fails to fulfil this condition, the amount of incentives will be liable to be recovered as land revenue arrears.

The Cabinet also granted sales tax exemption on the sale in Haryana of Lijjat Papad manufactured by Karnal-based Shri Mahila Griha Udyog Lijjat Papar unit, the only village industry in Haryana being run entirely by women for providing self-employment opportunities to the women from economically weaker sections of the society.

The Cabinet also decided to allow concessional rate of sales tax at 4 per cent on the purchase of scientific equipment and instruments made by Guru Jambheshwar University, Hisar.

Minister's assurance to sabha

ROHTAK, Feb 22 — The Education Minister, Mr Ram Bilas Sharma, has assured the local Brahman Sabha that the row kicked up following the withdrawal of functional powers of the Vice-Chancellor of Maharshi Dayanand University, Lieut-Gen O.P. Kaushik (Retd), will be settled soon.

A delegation of the Brahman Sabha, led by its president Suresh Chander Dutt, met the minister here today and sought his intervention in restoring the powers of the Vice-Chancellor. Mr Sharma told the delegation that he was in touch with the Governor and the Chief Minister and hoped that the issue would be solved in a couple of days.

Meanwhile, newspaper offices here have been flooded with statements issued by various organisations, supporting the action taken by the Governor and the Chancellor of the university, Mr Mahabir Prasad, and also in favour of the Vice-Chancellor.

The president of the Sarvajati Party, Mr Om Parkash Jindal, in a statement said the decision to withdraw the functional powers of the Vice-Chancellor was "politically" motivated. He said he would meet the Prime Minister on February 24 and apprise him of the situation prevailing on the university campus.

Mr Ramdass Athwale, MP Republican Party of India, alleged that the university had provided misleading information about the migration of MBBS students to Government Medical College, Rohtak. He said the Vice-Chancellor had not even bothered to reply to a letter vide which he had requested him to readmit expelled students.

Mr Joginder Singh Nandal, president, District Bar Association, welcomed the action of the Governor to institute a fact-finding committee to investigate allegations against the Vice-Chancellor.

Mr Surajbhan Sehrawat, president, Haryana Private Colleges Non-Teaching Employees Union, too, hailed the Governor's decision.

The Students Federation of India (SFI) said the Vice-Chancellors should be appointed through a democratic process and their powers decentralised.

The SFI described the inquiry against the Vice-Chancellor as a positive action and demanded that the probe should be impartial.

Welcoming the action taken by the Governor, the Sir Chhotu Ram Committee Centre said only an educationist should be appointed as a Vice-Chancellor.

The Evening Students Development Council also supported the action taken against the Vice-Chancellor.

Mahila Samiti rally on Women's day

Rohtak, Feb 22 — The All-India Janvadi Mahila Samiti has decided to hold a rally on the eve of international women's day on March 7 at Delhi to demand 33 per cent reservation for women in the Lok Sabha and state legislatures.

Mrs Jagmati Sangwan, secretary Haryana Unit said that the rally would also discuss issues relating to communalism and the rise in prices of essential commodities and chalk-out its future course of action.

She alleged that the BJP-led coalition government at the Centre had adopted a dilatory policy on the issue of the Women Reservation Bill and that the unabated rise in prices of essential commodities had put an unbearable burden on poor and middle-class families.

Mrs Sangwan alleged that while on the one hand the government was denying relief to the common man by withdrawing subsidies on the other hand it was allowing a free hand to hoarders and profiteers. Besides leaders of the mahila samiti, the Delhi rally will be addressed by Mrs Nilofer Bhagwat, wife of dismissed Admiral Vishnu Bhagwat, film celebrity Shabana Azmi, M.P. and Anjana Mishra, who suffered indignities in 'state sponsored' violence in Orissa, Mrs Sangwan said.

"The Society for Participatory Research in Asia also plans to hold a state-level mahila panchayat sammelan at Rewari on the eve of international women's day. The Panchayat and Development Minister, Mr Kanwal Singh will be the chief guest at the meeting.

Haryana Harijan Nigam for uplift of SC families

GURGAON, Feb 22 — The Haryana Harijan Kalyan Nigam (HHKN) has been set-up for the social, economic and educational uplift of the Scheduled Caste families in the district.

The Deputy Commissioner, Mr Krishan Kumar stated the nigam was executing several income generating schemes with monetary help in the form of subsidy and margin money by arranging bank loan. The Government of India started its participation in the shape capital of this corporation in the ratio of 49:51.

Mr Kumar said that upto January 1999, 466 beneficiaries had been assisted against the target of 950 beneficiaries by arranging loan of Rs 94.67 lakh from various institutions, inclusive of subsidy, margin money of Rs 27.01 lakh and Rs 12.72 lakh and bank loan of Rs 48.46 lakh.

He said that the Haryana Backward Class Kalyan Nigam was set up for social and economic benefit of backward class families and upto now around 5000 beneficiaries had been provided assistance to take self employment in Gurgaon district. He added that the union government had set up the National minority Finance Development Corporation for Social and economic welfare of the minority groups. Haryana government supports this corporation for the uplift of these groups, under which 1500 beneficiaries, minority groups are given help. As on January 14, 1999, 129 families has been benefited with a loan of Rs 27.25 lakh. He added that the Haryana Women Development Corporation gives assistance for employment and till now the Nigam had assisted 65 beneficiaries by giving subsidy of Rs 1.23 lakh margin money of Rs 3.58 lakh and bank loan of Rs 8.60 lakh. The Haryana Women Development Corporation had also given training in different trades like electronics, computer, steno-typist and cutting and tailoring. At present the nigam was imparting training to the beneficiaries in cutting, and tailoring in village Bhimgarh Kheri in Gurgaon.

Dharna against price hike

ROHTAK, Feb 22 — The constituents of the local Jan Sangathan Manch today staged a dharna at the mini secretariat in protest against the hike in the prices of wheat, rice, sugar and cooking gas.

The manch also opposed the patent and insurance regulatory Bills and alleged repression by the state government on its employees.

Addressing the demonstrators, Mr Ranbir Deswal of the Sarv Karamchari Sangh charged the government with pursuing policies which went against the farmers, employees, women and workers.

Criticising the government, he said that by imposing ESMA, it was trying to 'terrorise' the employees. The leaders of the Haryana Roadways Workers Union, CITU, Janvadi Naujawan Sabha, Student Federation of India and Khet Mazoor Union also addressed the demonstrators and called upon the people to unitedly oppose the anti-people policies of the Central and state governments.

Later, in a memorandum to the Prime Minister, submitted through the Deputy Commissioners, the manch demanded a re-survey of families below the poverty line, withdrawal of the policy of privatisation, reinstatement of the dismissed and suspended employees, withdrawal of ESMA and enhancement of job opportunities. The manch also demanded the introduction of 'food for work' policy.

Municipal staff to get salaries soon

YAMUNANAGAR, Feb 22 — All Municipal employees of Haryana will be given their salaries very shortly.

Dr Kamla Verma Local Bodies Minister, told deputationists of the Nagar Palika Karamchari Sangh Haryana here today that the state government had released a grant of Rs 6 crore for the disbursement of salary to the employees of almost all municipal council and committees.

She said at present, the government was not in a position to implement the 5th Pay Commission report, but assured them that it would be implemented once the financial position improved.

Representatives of the sangh had earlier demonstrated in front of the municipal council office and gave a memorandum to Dr Kamla Verma.

Mr Surinder Sharma, vice-president of the sangh, addressing the employees said if the government did not accept their demands, they would be forced to launch an agitation.

Their main demands include the implementation of the 5th Pay Commission report and cash payment of bonus.

It was decided at a meeting that the municipal employees would wear black badges from February 22 to 26 and would held dharnas in front of the office of the Deputy Commissioner on March 4.

Record power output at Panipat plant

CHANDIGARH, Feb 22 — The fifth unit of 210 MW of Panipat thermal power plant has generated a record power of 154.15 million units with a plant load factor of 98.66 per cent during January, since it became operational in 1989.

An official spokesman said here today that earlier the highest generation of this unit was 153.09 million units with a PLF of 97.88 per cent during January 1998. The recent record power generation had been achieved because of the untiring efforts made by the officers working at the plant after introduction of reforms and formation of Haryana Power Generation Corporation.

He said the first four units of 110 MW each were under a comprehensive renovation and modernisation programme at present. ABB Kraftwerbe of Germany had already taken up the second unit for this purpose and it was expected that the renovation would be completed within the next couple of months. The rest of the three units of 110 MW each were expected to be completed by undertaking the shutdown one by one by June 2000.

After this, the capacity of these four units would be increased from 110 MW to 118 MW and the PLF would also improve from 28 per cent to 80 per cent. By virtue of upgradation of these parameters, the state would get an additional generation of 2100 million units of electricity per annum, he added.

Nominations sought for Kabir Puraskar

CHANDIGARH, Feb 22 — The Haryana Government has asked the Director-General of Police and the Deputy Commissioners to recommend the names of persons for nominations for the "Kabir Puraskar" for the year by Match 15.

Those recommended should have made outstanding contribution to the promotion of communal harmony and national integration during 1998. The recommendations should invariably be accompanied by a brief note on the act of physical and moral courage displayed by the persons.

This award has been instituted by the Central Government to promote communal harmony by recognising acts of physical and moral courage and humanity exhibited by a members of one community in saving lives and property of members of another community. Such courage and promptness in saving the life and property of member(s) of another community would also involve a danger to the life, body and property of the rescuer or to his family members.

The award is given in three grades as grade I grade II and grade III, carrying a cash prizes of Rs 1,00,000, Rs. 50,000 and Rs 25,000 respectively. The awards are declared every year on October. 2.

There shall be no bar on persons receiving such award for a second time on a subsequent occasion. Persons in receipt of any other award or citation for the same act would not be eligible for the puraskar.

Cash awards for NGOs helping aged

CHANDIGARH, Feb 22 — The Haryana Government has decided to give a cash award of Rs 1 lakh to outstanding non-government organisations working for the welfare of widows and handicapped persons. A sum of Rs 648.23 crore will be spent on various social welfare schemes during the Ninth Plan period. Out of this, Rs 65.12 crore will be spent on welfare of handicapped.

This was disclosed here today by Dr Kamla Verma, Social Welfare Minister, while distributing prizes to the handicapped at a state-level function.

She also gave cheques to 10 widows, namely Shanti Devi, Santosh, Kamla Devi, Bimla Devi, Omvati, Shiksha Devi, Ram Pyari, Krishna Devi, and Mrs Kashmir Kaur under the national family benefit scheme. Bimla Devi and Omvati were given cheques of Rs 10,000 each, while others were given cheques of Rs 5000 each. She also presented hearing aids to Karam Singh, Tulsi Devi, Gopal Dass and Seema, while Dalip Kumar, Parveen Kumar, Vishnu Dutt and Jabir Singh were given tricycles.

She said the government had also decided to upgrade the Government School for the Blind at Panipat up to 10 plus 2 level. Besides, the government had also directed that public buildings should be provided ramps for the handicapped.

This was disclosed here last evening to reporters by Congress MLA, Captain Ajay Singh Yadav, Mr Suraj Bhan ex sarpanch of Kharkhara village and several other elderly relatives of the girl also announced that they would also convene a Mahapanchayat of all neighbouring villages on the issue soon after the Holi festival.

They said that Pushpa Yadav who wanted to go to her married sister's house at Khurrampur Kehra village near Farukh Nagar in Gurgoan district boarded a matador at Dharuhera in the afternoon of December 12 which took her to Gurgaon Satish Meena was the conductor while Rajesh was the driver of the matador. Satish Meena persuaded Pushpa Yadav to board another vehicle which he said would take her to Khurrampur Khera. Thus they deceitfully took her to Shahjehanpur (Rajasthan) where they stayed at the house of Kalyan Singh Meena a relative of Satish Meena after that Satish Meena alongwith Pushpa Yadav had been moving from one place to another. The Dharuhera which registered a case of kidnapping on December 14 against Satish Meena had been taking it lightly, they alleged. They also said that at their request to the police on different dates to Shahjehanpur and Jaipur in vehicles hired by them the police also arrested Kalyan Singh Meena from Shahjehanpur and Ram Sarup Meena from Jaipur at whose house Satish Meena alongwith Pushpa Yadav had spent many days in December and January. They further said that they met Mrs Ramkala Chandran, SP, Rewari, yesterday and urged her to expedite arrest of Satish Meena and restoration of the girl to the parents.

Mother-in-law, husband jailed

FARIDABAD, Feb 22 — Mr P.L. Goyal, Additional District and Sessions Judge, today sentenced Naresh, husband and Safedi, mother-in-law of Hodal to 10 and seven years rigorous imprisonment, respectively, holding them responsible for the death of Jalwati.

According to the prosecution, Jalwati was married to Naresh four years ago and died due to strangulation on May 29 last year. She was being subjected to harassment by both the accused by raising the demand of a motor cycle.

The judge observed that no leniency was called for in dealing with dowry death cases which were rising alarmingly. Even though the guilt of Safedi was on a par with Naresh. She was being awarded lesser punishment as she was a woman. Moreover, it was the duty of the husband to look after the well being of his wife.

Demonstration by INLD

FARIDABAD, Feb 22 — The district unit of the Indian National Lok Dal today held a demonstration outside the office of the Deputy Commissioner to press the demands of jhuggi dwellers.

The jhuggi dwellers' demands included provision of ration cards, electricity and water supply and stoppage of demolition operations till alternate accommodation is arranged for them.

The INLD also presented a memorandum to the Deputy Commissioner. Earlier, the demonstrators marched in procession from the NIT to the mini secretariat.

Petrol station looted

AMBALA, Feb 22 — A petrol station situated at Prem Nagar in the city was reportedly looted by two youths last night.

Mr Rakesh Kumar, a salesman at the petrol station, said the youths, one of them wearing a turban, came at around 10 p.m. in a white Contessa car (DIB 1354) and brandished a pistol. They forced him to hand over the cash amounting to Rs 6,000 and escaped.

A case has been registered under Section 356 of the IPC.

No arrests have been made so far.

One arrested for murder

FARIDABAD, Feb 22 — The police has arrested Jasbir of Haldwani on a charge of murdering Basanti Lal of Sarai Khwaja for refusing to marry his daughter with him on February 16.

A police spokesman said here today that Basanti Lal had arranged to job for Jasbir at a liquor vend in Gurgaon but used to take all of his wages on the assurance that he would marry his daughter with him. A few days ago Basanti Lal backed out of his assurance which angered Jasbir, who stabbed him resulting in his death on the spot.

Three pilgrims crushed to death

GURGAON, Feb 22 — Three persons were crushed to death and two others injured after a trailer ran over them on the Jaipur highway today.

According to information, the deceased have been identified as Niranjan, Phoolkumar and Kuldeep of Khanda village in Rohtak while those injured as Surender Kumar and Bijender Kumar.

They were part of a group of devotees going to Balaji in Rajasthan. Following the incident, the devotees blocked the highway for over two hours.

The blockade was lifted after administrative officials intervened.

The trailer got accidentally burnt in the incident after a live wire fell on it.

The driver managed to escape.

Couple brutally murdered by robbers

GURGAON, Feb 22 — Armed robbers killed a couple, Mr Sudhir Lal and his wife Kiran at their Sector 17 residence late last night.

According to information available, the couple was brutally battered by the killers and their heads were smashed with rods. The robbers took away jewellery and other items.

The police said that they were killed between 2 and 5 am as the victims were seen alive till 2 am. They had organised a party at their house last night and according to their domestic help Sambhu they slept thereafter.

In the morning when their driver came and found the house ransacked, he called the neighbours, who went inside and found the bodies of the couple in their bedroom. A VCR also found in the compound.

The couple lived alone and their son Sidharth is presently doing a course in Canada. Mr Lal was an advertising professional. A Delhi police team is also being involved in the investigation.

SONEPAT, Feb 22 — Ms Uma Bharati the Union Minister of State for Human Resources Development, urged the youth to promote Hindi as their mother tongue in every part of the country in order to strengthen nationalism and protect the glorious culture of India from onslaught by foreign culture.

Addressing a seminar organised by the district unit of the Akhil Bharatiya Vidyarthi Parishad in Hindu College here yesterday, she said that the people of the country were not proud of their cultural heritage.

Expressing grave concern over the migration of talented persons from India to developed countries, the Minister warned that if the government failed to provide proper facilities to these intellectuals, the nation would receive a setback at all levels.

Ms Bharati also lashed out at Congress policies and said that the Congress had always fomented casteism and communalism in the country.

Railway station reopens

HISAR, Feb 22 — The Mayyar railway station on the Hisar-Hansi section of Northern Railway resumed functioning today, after a gap of several months.

Giving this information the Station Master, Mr Ajay Gautam, said today that all passenger trains except express trains would halt as usual at the station.

The station was closed down a few months ago since then several organisations and residents of surrounding villages had been demanding reopening of the Mayyar railway station.

Pregnant woman attacked, injured

SIRSA, Feb 22 — Ms Sunita, a pregnant woman here received injuries when two persons allegedly tried to abduct her yesterday late evening when she was returning home after making purchases from a shop near her house. She alleged that Babu Ram (40), son Nittu (20) attacked her and tore clothes at night and misbehaved with her in a street near her house. She alleged that both accused were under the influence of liquor. The accused are reported to be absconded.

One killed, 4 hurt in mishap

HISAR, Feb 22 — One person was killed and four others were injured in an accident between a truck and a jeep near Sisar village in Hisar district today. The deceased has been identified as Dharamvir of Sisar village.

The injured Rajesh, Naresh, Leela and Ajay were hospitalised. A case has been registered against the truck driver. In another accident, a 22-year-old youth Devender was crushed to death by a vehicle near Agroha, 25 km from here. He was going along roadside last night when the vehicle crushed him to death.

INLD youth conference on March 13

AMBALA, Feb 22 — The president of the Haryana unit of the youth wing of the Indian National Lok Dal, Mr Ajay Chautala, said here today that a state-level conference of youth would be held at Dadri on March 13 to discuss the issues agitating the youths of the state.

Addressing a press conference, Mr Chautala said that the INLD would not support the BJP government at the Centre except in those cases where an issue involved public interest. In case, the Congress or any other brought a no-confidence motion against the BJP government over the issue of recent price hike, his party would support such a motion.

2 booked for felling trees

ROHTAK, Feb 22 — Two persons of Dharana village in the district have been booked by the police in connection with the illegal felling and selling of trees worth Rs 10,000.

According to a complaint lodged by the block forest officer, the accused, identified as Ramesh and Mohan, had felled some trees near Kalanaur.

Meanwhile, in two cases of theft, a truck valued at about Rs 9.5 lakh and spare parts worth about Rs 40,000 were stolen from Ramgopal Colony and Ramlila street, respectively.

Cases under Sections 379, 457 and 380 of the IPC have been registered.

In another incident, Suresh Kumar of Dhanodha village died when his motor cycle was hit by a vehicle on Saturday night.

In yet another incident, the police and a dog squad were requisitioned at the local Vishwakarma School to detect a bomb after someone informed the school authorities that a bomb had been placed in the building. However, it turned out to be a hoax.

79 Meo students given scholarship

GURGAON, Feb 22 — The D.P.S. (Mewat) school functioning at Tauru, Nuh and Ferozpur Jhirka has given scholarship to 79 students of the Meo community, Scheduled Castes and Backward Class bright students, according to Mr Williams Anand, Director, DPS (Mewat) school. According to the director, the scholarship had been given up to class IV and upwards. The DPS (Mewat) has provided these students with school books and dresses free of cost, she added.

Dewatering of sullage demanded

SIRSA, Feb 22 — Residents of the local Khairpur and adjoining areas have demanded that dirty water and sullage be drained out from the ground of government primary school. Residents of the area alleged that due to faulty sewerage in the areas sullage and dirty water had overflowed from sewerage line and ground of the school has been converted into pond of dirty water. Residents threatened an agitation if no steps were taken in this direction.
