Congress infighting intensifies

GURGAON, Jan 20 — After thwarting a move to topple his HVP-BJP government, Haryana Chief Minister, Bansi Lal, has managed to scuttle the Congress step to bring in a no-confidence motion against his ministry in the ensuing session of the state Assembly.

A source in the Haryana Cabinet today said in a deft move, the government has manipulated the commencement of the session at a time when the Congress will be busy with its much-publicised "kranti yatra" and the subsequent Jind rally on February 13.

The Congress leadership, smarting under the shrewd move, wants to expose those in the party who are alleged to have reached a tacit understanding with the Indian National Lok Dal of Mr Om Prakash Chautala.

According to sources HPCC chief Bhupinder Singh Hooda had made an announcement that a no-confidence motion would be introduced against the HVP-BJP government as part of a strategy to test if the principal Opposition party in the Assembly, the INLD, was sincere in pulling down the government.

Mr Om Prakash Chautala, who was here today, said his party was keeping its options open, including that of introducing a no-confidence motion against the government on its own. He charged that the Congress president was trying to save the government from a possible fall on the floor of the House.

In response to questions from mediapersons, he said his party would take a final decision at a meeting of its legislature wing on January 28. He however, said his party was serious in bringing down the government. He declined a categorical reply to a question whether his party would side with the Congress on its no-confidence motion.

A senior Congress MLA, Mr Dharambir Gauba, today added a new dimension to the issue saying that the move by Mr Bhajan Lal to install Mr Chautala as Chief Minister through the "backdoor" was not acceptable to the party rank and file. Talking to TNS, he said Mr Bhajan Lal had recently made a statement saying that he was in favour of Mr Chautala becoming the Chief Minister.

Also, the Congress would like to use the opportunity to test the MLAs of the Haryana Vikas Party who have been allegedly making covert moves to dislodge the government.

The Hooda lobby is said to be working on a strategy to bring about the fall of the government and a snap poll in the state. It feels a mid-term election would suit the Congress. In fact, planning in the inner circles is to get into an election mood immediately after the "kranti yatra" and the Jind rally.

A majority of MLAs are against Mr Hooda's strategy for bringing in a no-confidence motion. A majority of MLAs from the Bhajan Lal-Birender Singh lobby say they met the All-India Congress president, Mrs Sonia Gandhi, a couple of days ago on the issue. They expressed opposition on the ground that the Congress did not have sufficient number of MLAs to get the motion accepted for a debate and then voting.

Meanwhile, the government is understood to have stepped up intelligence on the whereabouts of a number of MLAs specially those of the HVP.

Haryana Lok Pal to be redesignated

CHANDIGARH, Jan 20 — The Haryana Cabinet which met here today under the chairmanship of the Chief Minister, Mr Bansi Lal, has decided to redesignate the post of Lok Pal as Lok Ayukt.

The Cabinet also approved the draft of a resolution to be passed by the State Legislature for repealing the Public Debt Act, 1944, and replacing it by a new Act, the Government Securities Act.

At present the borrowings of the State Government are in the form of government securities and are managed by the Reserve Bank of India. These matters are regulated by the Public Debt Act, 1944. The Union Government over the years, had noticed a number of rigidities in the Public Debt Act and rules. It has been felt that the procedures prescribed in this Act and rules have become time consuming and some of the provisions had become irrelevant.

The Union Government has undertaken a comprehensive review of this Act and all aspects of government securities management to simplify and rationalise the rules and procedure. This has been done by a committee consisting of the representatives of the Reserve Bank of India, Ministries of Finance, Law and Justice and State Governments of Madhya Pradesh, Maharashtra, Tamil Nadu, Uttar Pradesh and West Bengal. This committee has made recommendations to amend, repeal and add various sections of the existing Public Debt Act, 1944, and to replace it by a new Act namely "The Government Securities Act".

The Union Ministry of Finance has now sent a reference to the State Government proposing the repeal of Public Debt Act, 1944, and its replacement by "The Government Securities Act". The Central Government has approved this proposal. However, they have mentioned that this proposal can be given effect only with the prior consent of all the State Governments. The State Government has, therefore, been requested by the Union Government to have the necessary resolution passed by the State Legislature.

Cong 'to support' HVP rebels

CHANDIGARH, Jan 20 — The former Haryana Congress President, Mr Birender Singh, said here today that his party would respond positively if HVP rebels sought its help in forming a government in the State.

Talking to newsmen here, Mr Birender Singh said the Congress would not involve itself in horse-trading but it would not mind extending its support to a government formed by the HVP rebels even if they sought similar support from the Lok Dal.

Mr Birender Singh said the Congress would support such a government from "outside".

Answering a question about the possibility of the Congress moving a no-confidence motion against the Bansi Lal Government in the forthcoming Assembly session, Mr Birender Singh said the Congress Legislature Party would meet here on January 28 under the chairmanship of its Deputy Leader, Mrs Kartar Devi, to decide its strategy for the session.

He said if the session would be a winter session the party would like to adopt a different strategy which might include moving a no-confidence motion. But if the session would be the Budget session the party might not like to close its options for the next six months by moving a half-baked no-confidence motion. In the Budget session there would be many opportunities to defeat the Government.

It may be recalled that a no-confidence motion could not be moved within six months after the defeat of such a motion.

Mr Birender Singh said the decision taken at an informal meeting of the nine Congress MLAs to have floor coordination with other like-minded parties and MLAs did not contradict the stand taken by the party President, Mr Bhupinder Singh Hooda, that the Congress would not seek the support of other parties on the no-confidence motion it proposed to move in the Assembly.

The Congress leader expressed the confidence that the Bansi Lal Government would fall on the floor of the House in the forthcoming session.

SONEPAT, Jan 20 — The Indian National Lok Dal supremo and leader of the Opposition in the Haryana Vidhan Sabha, Mr Om Parkash Chautala said here today that no Congress leader had approached him to get support for the no-confidence motion proposed to be brought by the Congress against the Bansi Lal Government in the assembly session scheduled to commence from January 28.

Talking to mediapersons here, he said the Congress Legislature Party (CLP) did not have the strength for the passage of the proposed no-confidence motion. He accused the HPCC chief, Mr Bhupinder Singh Hooda, of misleading the people on this issue. He also charged him with trying to save the Bansi Lal Government instead of dislodging it from power.

Mr Chautala also pointed out that the Congress legislators had revolted against the HPCC Chief Mr Hooda on this issue as they wanted to get the replacement of Mr Hooda from the post.

He said that the legislators of his party would meet on January 28 at Chandigarh to chalk out the strategy on matters to be raised in the assembly session.

He also disclosed that a meeting of the district presidents, conveners of various cells and the members of the PAC of his party would be held on January 23 at Chandigarh to seek their suggestions for exposing the alleged misdeeds of the ruling HVP-BJP alliance government in the coming assembly session.

His party is preparing a memorandum listing the scandals and misdeeds of the Bansi Lal Government which would be presented to the President of India.

He alleged that the Bansi Lal Government had failed on all fronts and the farmers in the state were facing an unprecedented economic crisis because of unseasonal rains, foggy weather conditions, waterlogging and non-availability of power and fertilisers.

Later, addressing the meeting of party workers, Mr Chautala cautioned them against the attempts being made by the Congress to come to power in the state. The INLD, he hoped, would get a majority in the assembly elections and form the government on its own.

Governor to unfurl flag at Yamunanagar

CHANDIGARH, Jan 20 — The Haryana Government has decided to celebrate Republic Day on January 26 in a befitting manner. While the State-level function will be held at Yamunanagar where the Governor, Mr Mahabir Prasad, will unfurl the National Flag, the Chief Minister, Mr Bansi Lal, will unfurl the tricolour at Ambala at 10 a.m.

The Governor will be at home at the Tejli sports complex at Yamunanagar at 4 p.m. on the same day.

The Speaker of the Vidhan Sabha, Mr Chhattar Singh Chauhan, will preside over the Republic Day function at Karnal and the Deputy Speaker, Vidhan Sabha, Mr Faqir Chand, will unfurl the National Flag at Gohana.

The Ministers and Ministers of State will also hoist the National Flag at various places in the State on Republic Day. Scheme to restore Sultanpur park

CHANDIGARH, Jan 20 — The Haryana Wildlife Department has decided to implement an ambitious scheme of Rs 50 lakh to restore the glory of Sultanpur National Park, near Gurgaon, which receives about 250 species of migratory birds during the winter season.

This was revealed by Mr Subhash Chaudhary, Minister of State for Wildlife, while presiding over a meeting of the Haryana State Wildlife Advisory Board here today.

The Minister said that for supplying water to the Sultanpur lake, five cusecs of water would be brought through a pipeline from the Gurgaon water supply scheme canal. The Union Government had sanctioned Rs 43.05 lakh for this purpose. The work on this project would be completed before the onset of the rainy season and water would be taken to the lake before the next season of migratory birds. People could watch pelicans, storks, wigeons, ibises and other large number of migratory birds species in the lake and its premises, he added.

The board also approved the proposal of the Wildlife Department to take up biological control method for the control of water hyacinth in the Bhindawas Wildlife Sanctuary. He said to control the problem of water hyacinth it had been proposed to release two American weevils in collaboration with the Directorate of Biological Control, Indian Council of Agricultural Research (ICAR) at Bangalore. He said that the work on this project would be started in March next.

The board also gave its approval for the extension of the term of District Honorary Wildlife Wardens of all the districts for a further period of two years. The Animal Husbandry Department also agreed to set up a veterinary centre at Kalesar for immunisation of the cattle in the villages around the wildlife sanctuary.

Dr S.K. Mukherjee, Director, Wildlife Institute of India, suggested taking up of genetic studies on the red jungle fowl and the chinkara in the State in a big way.

Mr Naseem Ahmed, Commissioner and Secretary, Forest, Mr R.D. Jakati, Chief Wildlife Warden, Haryana, Dr H.S. Dahiya, Director, Animal Husbandry, Mr R.S. Hooda, Additional Principal Chief Conservator of Forests, and other members of the Wildlife Advisory Board participated in the meeting.

HC reverses contempt ruling against ADJ

CHANDIGARH, Jan 20 — The Punjab and Haryana High Court today reversed the order of the single Judge, Mr Justice N.K. Sodhi holding Mr M.M. Sharma, Additional District Judge of Rewari, guilty of contempt of court for violating the order of the Sessions Judge, Narnaul and slapping a fine of Rs 1,000 on him.

Mr Justice V.K. Bali and Mr Justice B. Rai, who delivered the order, held: "It is well settled that doubt cannot be equated with proof. Even if it is doubtful that the appellant did not have knowledge of the order passed by the Sessions Court staying the proceedings in the transfer application, the appellant, in our view, cannot be convicted for having committed contempt of the court under the Contempt of the Courts Act."

Mr Justice Sodhi had held Mr Sharma guilty of contempt of court on an application moved by Mr Dilawar Singh, Assistant Food and Supplies Officer, (AFSO), Rewari, saying that he had violated the order of the Sessions Judge staying further proceedings before the Additional Sessions Judge.

Although the AFSO claimed that he had conveyed the order of the Sessions Judge to the Additional Sessions Judge, the latter went ahead with conducting the proceedings.

It was this act of the Additional Sessions Judge which, in the opinion of the judge had constituted contempt of court.

Mr Justice Sodhi had observed: "The question that now arises is what should be the punishment that should be awarded to the Additional Sessions Judge. Considering the fact that he is a senior judicial officer with long stand, I punish him with fine of Rs 1,000.

On a request made by counsel for the Additional District Judge, Mr Justice Sodhi had stayed the operation of his order for two weeks to enable Mr Sharma to file an appeal.

The background of the case was that the AFSO was placed under suspension on December 31, 1997, by the departmental authorities. He had challenged the suspension order through a civil suit filed on January 6, 1998, which came up for hearing before the Civil Judge (Senior) Rewari, two days later. An application for grant of ad-interim injunction seeking to restrain the department from implementing the suspension order was also filed. While issuing notice to the defendants, the court had restrained them from implementing the impugned order.

Feeling aggrieved by the ex parte order of injunction the department preferred an appeal in the court of the Additional District Judge, Rewari, which came up for hearing before the respondent in the contempt proceedings. By his order dated February 9, 1998, the respondent allowed the appeal and set aside the injunction order. The petitioner then filed a civil revision plea (No. 603), which was disposed of on March 16, 1998, with the direction to the trial court to dispose of the application for ad interim injunction within two weeks from the date of receipt of the order. In addition the order should not be influenced by any observation made by the respondent in his order dated February 9, 1998.

The trial court disposed of the application granting ad interim injunction in favour of the plaintiff. The state of Haryana filed a civil appeal in the court of the Additional District Judge, Rewari, which again came up for hearing before Mr Sharma on May 27, 1998. The petitioner had filed a caveat, apart from filing an application for the transfer of his case from Mr Sharma's court on the ground that the Additional District Judge had already expressed his views while hearing the state appeal on February 9, 1998.

The District Judge issued notice for June 4, 1998, to the state of Haryana on a transfer application and in the meantime stayed further proceedings before the Additional District Judge. The stay order was conveyed by the AFSO to the Additional District Judge. However, he went ahead with the proceedings.

Women must play greater role: VC

KURUKSHETRA, Jan 20 — Kurukshetra University has chalked out a comprehensive programme for re-orientation of women study research centres in various colleges of the state.

This has been done to provide a more important role to women in social, educational and cultural life at the village and city level. A broad outline of the programme was given to women representative from 98 colleges of the state by Dr M.L. Ranga, Vice-Chancellor, of Kurukshetra University, here today.

The women delegates are attending a two-day workshop under a University Grants Commission-sponsored scheme. The workshop is being funded by the Haryana Government on behalf of the U.G.C.

Addressing the delegates, Dr Ranga lamented the fact that the dropout rate amongst girls at the primary level was about 73 per cent. The Vice-Chancellor said only up to 36 per cent women in Haryana were literate.

While everyone talked of ameliorating the lot of women, it was a sad fact that out of 7000 colleges in the country, only 500 were for women. Interestingly, even in women colleges, there were few women representatives in the management.

The Vice-Chancellor suggested proper co-ordination between women study research centre cells in colleges and government agencies working at the grassroots level. For instance, such cells should enrol the services of primary health centre workers, village workers, patwaris and other such people working in villages.

The women study centres along with these agencies, should guide women and girls at the village level on education, employment, handicrafts, hygiene and other related matters.

Dr Ranga said for effective functioning of the women research cells, separate rooms should be provided to these in colleges. These rooms should be equipped with literary magazines, newspapers and other material which was of interest to women. Women working in these cells should be given compensation in the form of duty leave so that they took their work seriously and not as a burden. At present neither there were separate rooms nor any facilities provided to women working in these cells in the colleges. The Vice-Chancellor regretted the fact that in a number of schools and colleges, there were no retiring or common room for women.

The Vice-Chancellor wanted that more girls and women at the village level should be involved in blood donation camps, social and literacy drives. He urged the women delegates to engage themselves in checking exploitation of women labourers.

Dr Ranga maintained that women in ancient India, especially during the Vedic and Ramayana period, enjoyed tremendous respect. It was only after the Vedic period that degradation in their lot was witnessed.

Dr Richa Tanwar, Director, Women Study Research Centre of the University, is co-ordinating the two-day workshop. Mr Jitender Aggarwal, Deputy Director, Director Higher Education, Chandigarh, represented the Haryana Government at the workshop.

Residential sector for poor planned

ROHTAK, Jan 20 — The Haryana Urban Development Authority (HUDA) plans a residential sector here exclusively for the poor and middle-class families.

Laying the foundation stone of a mini-secretariat building here yesterday the Urban Development Minister said the plots in the proposed sector would be provided at the rate of Rs 700 per sq yard. He, however, did not disclosed the site where the proposed sector would be carved out, but it is believed that it would be on the Gohana road adjacent to the proposed industrial area.

The three-storeyed new mini-secretariat building would be built in one year at a cost of Rs 2.35 crore. The building would have 39 rooms and would house those government offices which are presently functioning from rented buildings.

The minister said that a new judicial complex would also be built soon at a cost of Rs 2.50 crore.

He said the government proposed to beautify the Gau-Karan Talao at a cost of Rs 50 lakh.

The new building for Government Girls Senior Secondary School would soon be built on the Bhiwani road here. An industrial sector, too, was being developed, he said.

A dispensary based on selfless service

SIRSA: Selflessness and dedication clubbed with toil can work wonders. Service to human beings is service to God: this is the motto of the dispensary run by the Baba Bihari Charitable Trust, Sirsa.

Although the trust was formed 17 years ago in memory of Baba Bihari (a saint), its work was initially confined to religious and cultural activities. Last year social workers attached to the trust and a few local doctors decided to expand its activities in the field of health for the poor in the surrounding areas.

On January 14, 1998, they started a small dispensary on the premises of Baba Bihari Temple. Seven local doctors of different faculties volunteered to offer their services. Initially the trust got two doctors — a general medical practitioner and a specialist — to work two hours a day. Gradually the services of all doctors are used in rotation. Their numbers grew subsequently to 17 including three lady doctors.

In the first few weeks there were about 50 patients. The number rose to 150 and then to 200 patients per day. It is interesting to note that this dispensary, with a budget of just Rs 30,000 per month, serves about 200 patients, whereas the local Civil Hospital with a budget 50 times that amount serves 100 patients on an average per day!

When in the first six months of its operation there was no laboratory in the dispensary, Dr Jeevan Garg and Dr Parveen Garg, owners of leading laboratory in the town, provided lab facilities at a subsidised cost. This lab still has a charitable dispensary laboratory which can carry out only routine tests.

Another ambitious plan of the trustees fructified in November 1998, when a free eye camp was organised. A total of 355 patients were tested for eye ailments while 70 were operated for cataract. This camp was unique in the sense that everything was free — operation, medicine, food and spectacles and even food for attendants.

The small charitable trust can really be a model for others who want to do social work for the needy in a backward area. Credit goes to the selfless spirit of the 87 year old Sita Ram Bagla and his team of social workers inspired by the ideals of Vinoba Bhave and blessings of the Baba.

The trustees told this correspondent that it was a miracle that money flowed spontaneously owing to the Baba's goodwill, whereas Bagla opines that money is no handicap for those who work selflessly and sincerely for a social cause.

Haryana hikes annuity for awards

CHANDIGARH, Jan 20 — The Haryana Government has decided to grant annuity to those who were awarded Ashok Chakra, Kirti Chakra, Shaurya Chakra, Sena/Nao/Vayu Sena Medal and Mention-in-Despatches before July 1, 1985, at par with post-July 1, 1985, awardees, with effect from January 1, 1999.

The rate of annuity would be Rs 2400 for Ashok Chakra, Rs 900 for Kirti Chakra, Rs 600 for Shaurya Chakra, Sena Medal/Nao Sena Medal/Vayu Sena Medal and Rs 300 for Mention-in-Despatches.

Annuity will be given to those defence personnel who were domicile of Haryana at the time of joining the defence forces or at that time when they were awarded. The domicile status once established is not to be changed for further awards, even if there is a change in permanent residence. The annuity will not be admissible if cash award, monetary grant in lieu of land and annuity has been given by any other State Government to the awardees for the particular award. The annuity would be given for life to the servicemen or for life to the widow, if the decoration is earned posthumously or if the recipient dies before his wife. Also the annuity will be given to the widow of the deceased if she does not remarry. However, this restriction will not be applicable if she remarries the brother of the deceased.

Those recipients who had won these decorations more than once or Bar to decorations will be entitled to additional benefit of annuity as are applicable to each award.

Three shops gutted

AMBALA, Jan 20 — Goods worth several lakhs of rupees were reduced to ashes as three shops were gutted near Subzi Mandi in the Cantonment area last night. The Deputy Commissioner, Mrs Navraj Sandhu, and the local MLA, Mr Anil Vij, visited the spot. The Deputy Commissioner announced an ex-gratia of Rs 5000 each for the shopkeepers.

Corruption blamed on wrong policies

SIRSA, Jan 20 — The wrong policies of Chief Minister Bansi Lal were responsible for the bad economic condition, rampant corruption and stagnation in the state, Mr Jagdish Nehra, former minister and senior Congress leader, said while addressing public gatherings at various villages of Rori Vidhan Sabha constituency on the concluding day of his week-long public contact campaign today.

Talking about the law and order situation he said it had deteriorated in the state.

Another bridge collapses in Rohtak

ROHTAK, Jan 20 — A bridge recently constructed at Janata Colony collapsed today.

This is the second incident of its kind in the locality within the past week.

According to information received here, nearly 20 bridges have been constructed in this colony, having a population of about 60,000. Some of these bridges have not been opened for traffic so far.

Residents alleged that substandard material was used in the construction of the bridges.

Mr Anil Trikha, Vice-President of the district unit of the Indian National Lok Dal, has demanded an inquiry into the collapse.

Youth awards

SIRSA, Jan 20 — Prof J.B. Chaudhary, Vice-Chancellor, CCS Haryana Agriculture University, speaking at a valedictory function of the national youth week at Mulakan, 20 km from here, yesterday said the roots of prosperity lay in villages.

The youth week was organised by the local Nehru Yuva Kendra. A "gramin mela" and various competitions were held on the occasion.

District youth awards were presented to Dr Ramji Lal, Bhoop Singh, Lila Dhar Saharan and one other person by the Vice-Chancellor. The award carried a cash prize of Rs 500 and a certificate of honour.

The Yuva Club of Darbi village was adjudged best district youth club.

Kisan Sangh convention on Feb 6

YAMUNANAGAR, Jan 20 — A two-day convention of the Bhartiya Kisan Sangh of Haryana will be convened here on February 6 and 7.

Mr Shamsher Singh Tyagi, Press Secretary of the Bhartiya Kisan Sangh, said here today that main issues to be discussed at convention would be insurance policy for crops, construction of Dadupur Malvi Canal, and compensation for farmers whose crops had been damaged in unprecedented rain.

Sugar mill body's plea to CM

YAMUNANAGAR, Jan 20 — The Haryana Sugar Mills Workers Federation today appealed to the Chief Minister, Mr Bansi Lal, to accept its demands.

An agitation of the Saraswati Sugar Mills Labour Union today entered seventh day with 14 employees sitting on a relay fast.

Mr Kishan Singh, General Secretary of the federation, said services of those employees who had completed three years should be confirmed. He further said that there should be a ban on contractual labour.

Bid to rape 2-year old

ROHTAK, Jan 20 — A youth of Sundarpur village allegedly tried to rape a two-year-old yesterday.

He fled the village after he was spotted by someone.

According to the police, the youth reportedly picked up the girl from her house at about 3 p.m. and took her to a field on the pretext of taking her out to play.

The police has registered a case under Sections 376 and 511 of the IPC, but no arrest has been made so far.

Meanwhile, the police has registered a case against three persons in Kalanaur block for the illegal felling of trees in Garnavathi village of their district.

Villagers oppose land acquisition

ROHTAK, Jan 20 — Farmers of certain villages in Sonepat are up in arms against the notices of acquisition of nearly 600 acres of agricultural land by the Haryana Urban Development Authority.

The notices to acquire the land in Kundli, Nangal Kalan and Rasoi villages in the vicinity of Delhi were reportedly issued on December 11 last.

The farmers said the land along the G.T. Road was the most fertile in the district. The land had been leading in the cultivation of paddy, wheat vegetables especially mushroom, and flowers.

Mr Anoop Singh, assistant secretary of the state committee of the All-India Krishak Sabha, a majdoor sangathan, said the decision to acquire this stretch of fertile land by the government was anti-farmer and it would deprive thousands of farm labourers of their livelihood.

He said a delegation would soon meet officials concerned in Chandigarh and appeal to withdraw the decision.
