HPSC restrained from reverting Private Secy
CHANDIGARH, Dec 2 — The Punjab and Haryana High Court has restrained the Haryana Public Service Commission from reverting Mr Lal Chand Sharma, Private Secretary, to the post of Personal Assistant.

Lingdah, the Election Commissioner in directing Mr Om Prakash Chautala, Haryana Chief Minister, on the eve of the Lok Sabha election on September 4, to go out of Bhiwani parliamentary constituency, Mr R.S. Cheema, appearing for the commission, contended that only purpose of the impugned direction was to hold free and fair elections and that it was wrong to suggest that Mr Chautala was prevented from voting since he was voter in the Sirsa parliamentary constituency.

Refresher course begins at HAU
HISAR, Dec 2 — A four-week refresher course on faculty development in research management began at CCS Haryana Agricultural University (HAU) here today.

Change in MC ward reservation
SHAHABAD, Dec 2 — The reservation of wards of the Municipal Committee, has been changed. Out of a total of 17 wards in the city, two wards have been reserved for the Backward Classes instead of one at present.

Court summons former DC
ROHTAK, Dec 2 — The court of the Chief Judicial Magistrate (CJM), here has summoned a former Deputy Commissioner, Mr Arun Kumar, IAS, Mr R.K. Chauhan, HCS, and three others in connection with the demolition of a "structure" of the District Bar Association.

Bus stand yet to be made operational
AMBALA, Dec 2 — Even four months after its inauguration, the new bus stand at Ambala Cantonment is yet to be put to work. Built at a cost of about Rs 4 crore, the 'most modern bus stand of Haryana' was inaugurated by the then Chief Minister, Mr Bansi Lal.

600 km of roads to be repaired
SIRSA, Dec 2 — About Rs 216 crore will be spent on the repair of about 600 km of roads in the district, Deputy Commissioner Amit Jha said here the road repair work would be executed through the market committee HUDA and the panchayati raj organisation. The PWD and the Marketing Board had been assigned the repair work of 100 km of roads each.

Four held for beating man
SIRSA, Dec 2 — Four persons were arrested for beating some persons who had filed a dowry case against them in Dabwali subdivision of the district, according to press note issued by the police today.

INLD, BJP resolve differences

CHANDIGARH, Dec 2 — The differences between the ruling Indian National Lok Dal and the Haryana unit of the Bharatiya Janata Party have been resolved.

According to informed sources, the differences, which were based on a misunderstanding, were resolved at a luncheon meeting between the Chief Minister, Mr Om Prakash Chautala, and three senior-most leaders of the Haryana BJP here yesterday.

The BJP leaders who met the Chief Minister were Mr Om Prakash Grover, President, Mr Ram Bilas Sharma, Leader of the BJP Legislature Group, and Mr Manohar Lal Khattar, General Secretary (Organisation). Mr Khattar is the most important General Secretaries of the party because he is a link between the Haryana BJP and the RSS.

The sources say the meeting was held at the initiative of Mr Grover, who accompanied Mr Chautala from Delhi in the State plane yesterday. Mr Sharma and Mr Khattar were already here in connection with a meeting of the BJP MLAs held here on November 30.

The two meetings were held in the backdrop of realisation among the leaders of both parties that neither had an option to contest the next Assembly elections other than in alliance with each other, if the Congress was to be kept out of power in Haryana.

The sources say contrary to a negative perception about the relationship between the INLD and the BJP, primarily generated by "blow hot" attitude adopted by certain Haryana BJP leaders, Mr Chautala has been able to establish a good rapport with the BJP triumvirate — Vajpayee, Advani and Thakre. He received Mr Advani at Bahadurgarh when the latter came to Rohtak to address the Shakti Sammelan of the BJP last month. Mr Advani and Mr Chautala were alone for about half an hour in the Bahadurgarh rest house.

The BJP's national leadership as well as the top echelons of the RSS, the sources say, share the perception of the INLD leadership that early Assembly elections in Haryana are in the interest of the two parties. Senior Haryana BJP leaders admit in private that since the two parties have to contest the next elections together, it is a bad strategy to project a picture of adversary relationship.

Sources in the BJP say certain MLAs had a few reservations about the style of functioning of the Chief Minister, particularly on issues like transfers and postings and appointment of patwaris selected during the Bansi Lal Government. They complained that even at those stations which were represented by the BJP MLAs, the Government had appointed key officers without taking the MLAs into confidence.

Sources in the INLD say it is true that initially no MLA of any party was taken into confidence while posting officers after the change of government. However, wherever the MLAs complained about specific officers, they were transferred. The same policy was adopted towards the BJP MLAs also.

In Mahendragarh, the Government had posted Mr Pirthi Singh Saini as the S.P. But Mr Ram Bilas Sharma wanted Mr R.C. Mishra, who was shifted from Mahendragarh, the native district of the BJP leader, by Mr Bansi Lal after the BJP fell out with the HVP leader. The Chief Minister, the sources say, ordered the posting of Mr Mishra in Mahendragarh.

About the appointment of the patwaris, the Lok Dal sources say, most of the MLAs who joined the INLD after the fall of the Bansi Lal Government are of the view that the appointment letters should not be issued because only a few nominees of theirs were accommodated by the Subordinate Services Selection Commission.

No affiliation despite NOC

ROHTAK, Dec 2 — Can the university withhold inspection and subsequent affiliation after issuing a "no-objection certificate" for setting up an institution (law college) in the private sector?

The Adhiyaman Educational and Research Trust headed by Dr M. Thambi Durai, a former Union Minister of Law, Justice and Company Affairs, sought permission from Maharshi Dayanand University to set up a law college at Faridabad. The university in June 1998 issued a "no-objection certificate" to the trust for starting the college.

The trust, on the basis of the NOC issued by the university, obtained approval of the Bar Council of India and the state government for setting up the college under the name of "National Institute of Law" at Faridabad.

The trust, after creating the desired infrastructural facilities, applied to the university in May, 1999, for inspection of the institution for subsequent affiliation. The Vice-Chancellor on June 18, 1999, constituted a three-member committee comprising Dr L.C. Dhingra, Dr P.C. Juneja and Dr I.S. Muhar to visit the college and submit its report.

Interestingly, the inspection committee did not visit the college and in the meantime one of the members, Dr I.S. Muhar, retired from the university service. Why the inspection was not carried out is a mystery.

Although the inspection team did not visit the college a representative of the university (Mr S.N. Sharma) visited the college on July 21 and found the infrastructural facilities created by the trust in order. This fact was brought on record by Mr Thambi Durai in a communication to the Vice-Chancellor on July 27.

Meanwhile, a committee of the Law Department of the University held a meeting on November 24 to resolve that the "university should strict to the policy of not granting affiliation to any private college/institution, including government college, to run law course(s) within the jurisdiction of this university". The meeting was chaired by Dr L.C. Dhingra who is also convener of the inspection committee.

Highly informed university officials said the recommendations of the departmental committee could in no way hamper inspection under Statute 38 of the MDU Act, 1975. Moreover, the policy-decision whether there should be a private law college fall within the domain of the Bar Council of India and the state government and not the university.

Meanwhile, the Vice-Chancellor has ordered that the recommendations of the departmental committee be placed on the agenda of the Academic Council scheduled to meet on December 6.

The trust it is learnt, has filed a writ petition in the Punjab and Haryana Court to seek directions to the university for conducting inspection and granting affiliation. The next date of hearing has been fixed for December 8.

EC’s order to Haryana CM defended

CHANDIGARH, Dec 2 — Defending the action of Mr J.M. Mr Cheema was arguing before Mr Justice T.H.B. Chalapathi who had earlier been issued suo motion notice to the Election Commissioner for his alleged order.

Making a plea against issuance of a notice to the Election Commissioner by the court, Mr Cheema contended that it was not a case in which the court should have initiated suo motu proceedings.

According to him, suo motu proceedings should be initiated in three types of cases. In the first case was the magnitude of the crime in which police investigation is necessary. The second category was in which the police was involved and the third where the victim was indigent and helpless. This case did not fall in any of these categories. Mr Chautala, if he was aggrieved, could have filed a complaint, counsel said.

Since Mr M.L. Sarin, who was to assist the court in this case, has assumed the office of Advocate-General, the Judge directed Mr H.S. Mattewal, Punjab's Advocate-General, to assist the court.

The case was adjourned to December 15.

Refresher course begins at HAU

HISAR, Dec 2 — A four-week refresher course on faculty development in research management began at CCS Haryana Agricultural University (HAU) here today. It is being attended by 30 farm and animal scientists from Gujarat Maharashtra, Kerala, Bihar, Himachal, besides Haryana.

The course was inaugurated by the recipient of the ICAR's coveted Best Extension Worker Award, the Dean, College of Home Science, Dr Indu Grover. In her address, she appealed to the participants to set research priorities in view of the needs of the country. She said though the country had succeeded in attaining self sufficiency in agriculture, yet larger areas remained unexplored. Complimenting the Indian farm scientists, she said that could lead the world if more funds were made available for research and development.

Speaking on the occasion, Dr B.L. Jalali, Director of Research, said our research pursuits could be meaningful only if they were of practical utility and benefited the farmers. He urged the participants to undertake research of practical applicability rather than of academic nature.

Dr Jalali, who is also the Director of the course, revealed that specially tailored lectures would be delivered during the course.

Dr S.S. Bishnoi, Course Coordinator, while highlighting objectives of the course said the participants would be apprised of various managerial aspects, besides improving their skills needed for effective implementation and conception of research projects.

BJP against mid-term poll

FATEHABAD, Dec 2 —The BJP will oppose any move by the Haryana Chief Minister, Mr Om Parkash Chautala, for a mid-term poll for the state Assembly and the party will stake its claim to at least 45 seats if it contested the future Assembly poll in alliance with the INLD.

Speaking to mediapersons here yesterday, Mr Shri Niwas Goyal, Vice President, state unit of the BJP said the party was against a mid-term poll in the state from the very beginning. The party, he said wanted that the Om Parkash Chautala government should complete the remaining term of the Assembly and concentrate on the welfare of people. He said the party had already apprised Mr Chautala of its viewpoint on the issue.

Mr Goyal said the BJP as his party contested five parliamentary seats in the last parliamentary elections its decision to stake claim to 45 seats was not wrong. He added that if the INLD did not accept its demand for 45 Assembly seats, the BJP would go it alone on all 90 Assembly seats in Haryana.

Regarding the party's stand on not joining the Om Parkash Chautala government in the state, Mr Goyal said the BJP did not have a good experience when it joined the Bansi Lal government in Haryana so it had decided to support the Chautala government from outside.

Change in MC ward reservation

SHAHABAD, Dec 2 — The reservation of wards of the Municipal Committee, has been changed. Out of a total of 17 wards in the city, two wards have been reserved for the Backward Classes instead of one at present.

The Wards Number 5,7, 10, 11 and 15 which are reserved for women candidates at present will be general category wards in addition to wards No 6, 13, and 16. The wards number 1, 4, 12, 14 and 17 will be general women's wards. The wards number 2 and 8 will be reserved for the candidates of Scheduled Castes respectively. The reserve wards are changed by rotation.

The men's ward number 4 will now be a women's ward while the women's ward number 5, which is presently represented by the vice-president of the committee, Dr Mrs Sudha Bansal, will be a general men's ward, Prior to Mrs Bansal, this ward was represented by her husband, Dr Narendra Bansal, President of the local unit of the BJP.

The committee will now have six women, including one from the Scheduled Castes, eight general caste, one SC male member and two Backward Class members.

Court summons former DC

ROHTAK, Dec 2 — The court of the Chief Judicial Magistrate (CJM), here has summoned a former Deputy Commissioner, Mr Arun Kumar, IAS, Mr R.K. Chauhan, HCS, and three others in connection with the demolition of a "structure" of the District Bar Association.

According to Mr R.P. Tomer, who had filed a criminal complaint in the court, the demolition of the chambers of advocates was carried out allegedly without any notice as required under the Haryana Municipal Act on the night of June 30 this year. It has been alleged that the Act had been illegal and a result of high-handedness of the district administration.

The other accused named in the complaint are Mr Ram Kumar, SHO, Civil Lines police station, Mr Anand Jain the then Executive Officer of the Municipal Council, and Mr Dharam Chiller, secretary of the Municipal Council here.

Bus stand yet to be made operational

AMBALA, Dec 2 — Even four months after its inauguration, the new bus stand at Ambala Cantonment is yet to be put to work. Built at a cost of about Rs 4 crore, the 'most modern bus stand of Haryana' was inaugurated by the then Chief Minister, Mr Bansi Lal.

About 20 per cent of the construction work was lying pending when it was inaugurated.

At present, though the construction work has been completed and the Public Works Department has also given the green signal, the bus stand is yet to be made operational.

According to the Deputy Commissioner. Mr Ram Niwas, the bus stand will soon be made functional.

600 km of roads to be repaired

No shopkeeper would allowed to encroach upon public land at any cost. Regulating traffic and strengthening the transportation system would be given priority.

To improve sewerage in Sirsa, a 72" sewerage line would be laid at a cost of Rs 480 lakh from Balmiki Chowk to the disposal tank.

Mr Jha asked Dr R.C. Bhutani, Chief Civil Surgeon, to submit his report regarding the allegations made against a doctor in the Civil Hospital, Ellenabad, for changing a report after exhorting money.

Four held for beating man

SIRSA, Dec 2 — Four persons were arrested for beating some persons who had filed a dowry case against them in Dabwali subdivision of the district, according to press note issued by the police today.

Lam Singh, Iqbal Singh, Gurmal Singh and Habant Singh were booked by the police under Sections 506, 323, 148 and 149 on the complaint on Gurcharan Singh Satyana village in Muktsar (Punjab). Gurcharan had alleged that the four had beaten him and also threatened to kill him and Gobind Singh, Janrail Singh, Gurdial Kaur when they were going back after appearing in the court.

The cause of the assault is said to be a dowry case filed by Gurpreet Kaur, the wife of the complainant's brother-in-law.

Hardcore criminal arrested

PANIPAT, Dec 2 — The district police has arrested a hardcore criminal Pradeep allegedly involved about a dozen cases of theft and robbery, including looting of Rs 80,000 from a clerk and peon of Government High School, Dharamgarh on September 1, in Matloda.

The SP Mr M.S. Mann told mediapersons today that Pradeep was reportedly operating a gang from a house in his fields when he was arrested by Matloda police on November 30. A pistol and a stolen motorcycle were seized from him.

Robbery bid thwarted

PANIPAT, Dec 2 — The brave efforts of a clerk and a teacher of government school Bapoli thwarted a robbery attempt by three persons outside the branch of the State Bank of India at Bapoli yesterday.

According to available information, no sooner had the clerk, Ms Saroj, and the teacher, Mr Sukhbir Singh, reached their school after drawing the salary amount of Rs 1,52,817 from the bank then three persons riding a red-coloured Hero Honda motor cycle stopped them and tried to snatch the money bag. During the tug of war between the clerk and the three the plastic money bag was torn and currency notes were dropped on the road.

In the meantime school employees and a number of people from the adjacent Balmiki Mohalla raised the alarm and rushed to the spot. Apprehending being caught, the gangsters escaped on their motor cycle and took away only Rs 12,817. The police has launched a hunt to nab them but so far no one has been arrested. A case has been registered in the sadar police station.

Award for Hindi poet

HISAR, Dec 2 — Hindi poet, author and Hisar-based Staff Correspondent of Dainik Tribune, Kamlesh Bharti was conferred this year's Parmanand Sharma Award for his contribution to literature and journalism, by the Sahitya Kala Sangam.

The award was presented to him by poet Uday Banu Hans at a function organised at the Sarvodaya Bhavan. The award carries a shawl, a citation and Rs 1,100 in cash.

Speaking on the occasion Mr Hans, lauded the contribution of Kamlesh Bharti to Hindi literature.

Several other speakers also appreciated the work of Mr Bharti.

2 dowry cases registered

ROHTAK, Dec 2 — Two cases of dowry harassment and one case of car theft have been registered in Rohtak and Bahadurgarh towns in the past 48 hours. One case of robbery, in which thieves decamped with cash and valuables worth Rs 15,000 from a house in a local colony has also been reported.

According to police sources, five members of a family of Kanonda village in Jhajjar district were booked under various Sections of the IPC on a complaint lodged by Riku, who had been married in the family. She belongs to Ladpur village and has alleged dowry harassment by her in-laws.

In another case three male members of a family of Rohtak were booked on similar charges. Meanwhile, a Maruti car (DL 6C-4594) was allegedly stolen from Green Road on Tuesday.

Record production of mushroom likely

CHANDIGARH, Dec 2 — Haryana expects to achieve a record production of 3600 tonnes of mushroom during 1999-2000 as against 2850 tonnes during the last year.

Stating this here today, a spokesman of the Horticulture Department said the state was fast emerging as a leader in the field of mushroom production. He said the main mushroom growing districts were Sonepat, Karnal, Panipat, Gurgaon, Ambala, Yamunanagar and Panchkula.

He said the mushroom cultivation was labour intensive and generated employment for specific group of small and marginal farmers and educated youth.

Prasad's assurance to disabled

CHANDIGARH, Dec 2 — Haryana Governor Mahabir Prasad and Chief Minister Om Prakash Chautala have reiterated the commitment of the state government to take effective steps for the welfare of disabled.

In a message issued on the eve of World Handicapped Day, the Governor urged the people not to consider disabled a burden and should work for bringing them in the mainstream.

Mr Chautala said the government was considering a proposal to open 26 integrated schools for disabled. The government had identified 1100 posts for disabled in the state, he said.

HUDA community centre

CHANDIGARH, Dec 2 — The Haryana Urban development Authority (HUDA) will develop a community centre costing Rs 55 lakh at Sector-1 Ambala City.

Giving this information the Deputy
Commissioner of Ambala, Mr Ram Niwas, said here today that Mr S.C. Chaudhary, Special Principal Secretary to the Chief Minister, Haryana, would lay its foundation stone on December 4. It would be completed within a year.

CHANDIGARH, Dec 2 — The Punjab and Haryana High Court has restrained the Haryana Public Service Commission from reverting Mr Lal Chand Sharma, Private Secretary, to the post of Personal Assistant.

Mr Justice R.S. Mongia and Mr Justice J.S. Narang, who handed down this order, also issued notice to the respondent commission for December 21.

The bench held: "On the oral prayer of the learned counsel for the petitioner, Mr G.L. Batra, former Chairman, Haryana Public Service Commission, is impleaded as respondent."

In his petition Mr Sharma stated that he had been promoted to the post of Private Secretary for four months, subject to approval of the state government. On April 26, 1995, the commission allowed the petitioner to continue on the promotional post of Private Secretary, subject to the government's approval. While sending the case for approval for his promotion to the post of Private Secretary, it was mentioned that 70 per cent of his service record was good and that he was fully eligible for promotion. It was further stated that he was the seniormost Personal Assistant in the commission.

In his letter dated June 27, 1996, the then Chairman of the commission, Mr Batra had stated that "Mr Lal Chand Sharma has been working at my desk since the day I joined as Chairman, Haryana Public Service Commission, and I am satisfied with his work".

The respondent commission, however, passed an order on February 13, 1997, reverting him to the post of Personal Assistant with retrospective effect on "mala fide grounds without assigning any reason." the petitioner alleged.

3 dead, 10 hurt in bus-jeep collision

HISAR, Dec 2 — Three persons were killed and at least 10 injured, four of them seriously, head-on collision between a Haryana Roadways bus and a jeep, near Bithmara village about 40 km from here today.

The jeep was on its way to Uklana while the bus was going towards Tohana when the accident took place.

The jeep rolled into a khud after the accident. The victims has been identified as Ram Kumar (40) and Surta (35) of Bithmara village and Karma (28) of Ramgarh. The seriously injured Satbir, Desraj, Chhabil Dass and Mohammada were admitted to Hisar and Tohana hospitals. Some of the injured were admitted to hospital in Uklana.
