Consumer Courts
Phone not repaired; GM penalised
Tribune News Service

CHANDIGARH, July 5 — The UT Consumer Disputes Redressal Forum-II has directed the General Manager, Telecom, to pay a compensation of Rs 1,100 to the complainant for not getting his telephone repaired despite repeated reminders.

In his complaint, Mr K.M.S Bedi, a resident of SAS Nagar, has contended that his telephone had been out of order since May 30, 1997, and a report had been lodged at phone number 198. He has further stated that he repeated the complaint daily till June 4, but there was no response. On June 5, he reported the matter to a JTO, but no action was taken. After repeated visits proved futile, the complainant went to the office of the SDO, Telephones. Subsequently, he reported the matter to the PA of the General Manager, Telephones.

He has alleged that though his telephone was repaired, it functioned only for some time and went dead again. Upon being served a legal notice, the department got into action and set his phone in order. The complainant claimed Rs 9,000 as refund of expenses incurred and costs of litigation.

The department in its reply stated that the complainant had lodged the complaint on June 4 and not on May 30, 1997. It further pleaded that the problem was due to an underground defect in the cable at the place of its location. And that the defect was rectified on June 11.

The forum Bench comprising its President R.P. Bajaj and members H.S Walia and Kamlesh Gupta held the department guilty of deficiency in services as it failed to attend to the complaint of the subscriber in a reasonably prompt manner. They further observed that in the absence of supporting documents, the plea of the department does not justify the long delay in rectifying the defect.

Insurance plea rejected

The UT Consumer Disputes Redressal Forum-II has rejected the insurance claim of a city resident against his damaged motor cycle on grounds that he was holding a learner's licence at the time of the accident and he was also not accompanied by a trained driver.

The complainant, Mr Ranjodh Singh Jamwal, got his Yamaha RX-100 insured with Oriental Insurance Company Ltd and also paid Rs 268 as premium for the same. The insurance cover was valid up to May 25, 1996.

He further stated that the motor cycle met with an accident on May 30, 1995, and intimated the loss to the company, which appointed a surveyor to assess the same. But later when he submitted the claim of Rs 40,000 the same was repudiated by the company.

In its reply, the insurance company contended that the complainant neither had a valid driving licence nor was he accompanied by a trained driver at the time of the accident.

The forum Bench comprising its President H.C. Modi and members R.K Behl and Shashi Kanta held that no insurance claim could be awarded to the complainant since he was driving the vehicle in violation of the conditions of the Insurance Policy and the Motor Vehicle Act.

While going into all aspects, the forum observed that the company had rightly repudiated the claim. It also took into consideration an Andhra Pradesh High Court judgement cited by counsel for the company, wherein claim has been denied to a person holding a learner's licence. The judgement specifies that "the policy does not cover the risk if the vehicle is being driven by the person holding a learner's licence. ''

Refund ordered

The UT Consumer Disputes Redressal Forum-II has directed Mr Ved Nanda, Director, and Mr J.L Nanda, Managing Director of Druckgrafen India Ltd, to refund the principal amount of Rs 1.6 lakh to the complainants. The complainants had alleged that the same had not been paid back in time along with the promised interest for a certain period.

The complainants, Mr Jagdeep Singh and Mrs Davinder Kaur, had alleged that they had deposited Rs 1.6 lakh with the respondent company by way of two fixed deposits of Rs 80,000 each, for a period of six months.

They further stated that the company had undertaken to pay interest at the rate 15 per cent per annum and the deposit was to mature on January 26, 1998. Though the company paid interest up to April 30, 1998, but failed to pay the same for a period beginning May 1, 1998. They further submitted that no payment was forthcoming despite repeated requests.

The forum Bench comprising its President R.P. Bajaj and members H.S. Walia and Kamlesh Gupta held that the case of the complainants has not been rebutted. The case is also supported by an affidavit. They also observed that non-refund of the principal amount, sought by the complainants along with the interest due on the same is an act of grave deficiency.

While allowing the complaint, the Bench directed the company to pay Rs 550 as costs incurred by the complainant, besides returning the principal amount along with interest at the agreed rates.Back

Our Sports Reporter

CHANDIGARH, July 5 — It was more than a dream come true for tennis lovers, the players themselves and millions of Indians when on Sunday the duo of Leander Paes and Mahesh Bhupathi gave India the rightly deserved Wimbledon men's doubles title which could keep alive the hopes of the sports fraternity in general and the tennis fraternity in particular for long. Earlier this pair bagged the men's doubles crown in the French Open Championships and reached the finals in the same event of the Australian Open also.

With the dismal performance of the Indian cricket team which did not perform according to the high expectations of the people of the country this win has given a big boost to the morale of the sports followers in the country. Leander also later annexed the mixed doubles title in combination with Lisa Raymond. The combination of Paes and Mahesh have shown the world that in tennis, India is a force to reckon with.

In the past Vijay Amrithraj and his brother, Anand, had only once reached the semi-finals in the men's doubles event at Wimbledon and these players were the pride of the country, uttered Mr Rajan Kashyap, Chairman of the Chandigarh Lawn Tennis Association.

Mr Kashyap recalled the long association Paes and Bhupathi had with Chandigarh because they used to play in Chandigarh . Moreover, few years ago Paes for the first time won the National Championship by playing at Chandigarh. These players were earlier sponsored by the PUNWIRE and they had become a role model for the budding players opined Mr Kashyap.

Mr Kashyap also sent congratulatory messages to Paes and Mahesh at their homes and said the CLTA would like to honour these great players who had a long association with Chandigarh tennis.

The President of the Haryana Tennis Association and another sporting figure of Chandigarh, Mr D.V. Bhatia, said that the whole of India must be proud of this glorious and historic win this duo had done for the entire country. Now India could hope for a better future in tennis.

Mr Kailash Nath , Manager, CLTA, Sector 10, hoped that these Indian players would definitely continue with more grand slam wins like the US Open in the near future. The win had given a big name to India.

A senior coach and former junior Wimbledon quarter-finalist Mayank Kapoor said now we could look forward to more such wins as the barrier had been broken and it had really opened the doors for the coming generation of younger players. Earlier one could never think beyond the Krishnans and the Amrithrajs and it could be expected that like Paes and Bhupathi the list of title winners would grow.

When asked about the mastery or the edge these players had, Kapoor said that they were superb in the net game which proved to be the plus point in such wins.

A promising player at the CLTA courts, Ms Harsimran Kaur, too was delighted with this magnificent win by the Indians. Harsimran who has taken part in various ITF meets and reached the quarter-finals in the Mumbai tournament two months back, hoped to do something for the country with this encouragement.

The coach at the Lake Club, Sector 6, Sandeep Singh too was overjoyed with this nice win by the Indian pair and recalled that these players had frequently participated and practised tennis here at Chandigarh.
