5 get life imprisonment in four-year-old murder case

A local court has sentenced five persons — Bharat, Gurdev, Anil Kumar, Pardeep Kumar and Rahul, all residents of Mauli Complex, Chandigarh — to undergo life imprisonment in a four-year-old murder case. The court has also imposed a fine of Rs 5,000 on each accused.

The police registered the FIR on April 16, 2021, under Section 147, 148, 149, 302, 120B of IPC at Police Station Mauli Jagran, Chandigarh.

The complainant’s son Amit Kumar took a scooter from his friend, Bharat. However, he met with a minor accident and the scooter was damaged. After the incident, Bharat, along with his friends started fighting with Amit.

The complainant alleged that his son gave Rs 1,500 to Bharat for the damages, but they kept fighting. On April 16, 2021, the accused came to his house and asked about his son Amit. He told them that Amit was not at home.

Later, a person from his colony informed him that his son was stabbed by Bharat and was seriously injured at Mauli Complex.

Police reached the spot after receiving information regarding incident. The victim was taken to Civil Hospital, Sector 6, Panchkula, for treatment. However, he was declared brought dead by the doctor. During investigation, the accused persons were arrested.

Thereafter, statements of witnesses were recorded and the weapon was recovered on the disclosure statement of the accused.

After completion of the investigation and other necessary formalities, challan was presented before the court. Finding prima facie case, charges were framed against the accused under Section 302 of the IPC, to which the accused pleaded not guilty and claimed trial.

Counsels for one of the accused argued that they were falsely implicated in the case. However, the public prosecutor argued that the prosecution has proved the case beyond a shadow of doubt. After hearing of the arguments, the court held the accused guilty of charges framed against them. The court sentenced all the accused to undergo life imprisonment and imposed a fine of Rs 5,000 each.
