Chandigarh: Chargesheet filed in BMW hit-&-run case

The police have filed a chargesheet against him in the court under Section 105 (culpable homicide not amounting to murder) of the BNS. It outlines the punishment for causing death without intention but with the knowledge that the act is likely to cause death. This Section replaces Section 304 of the Indian Penal Code under the new laws.
According to the police, the accused fled the scene in his BMW car after hitting constable Anand Dev, who was riding a bicycle, in the evening of May 11 this year. The accident took place at the Sector 9-10 traffic lights near the Police Headquarters in Sector 9 here. Roy was arrested the next day.
The police initially registered an FIR under Section 282 and 106(1) of the Bharatiya Nyay Sanhita on a complaint filed by Ashish Choudhary. He told the police that the speeding BMW car hit the bicycle and fled the scene. The police added Section 105 of the BNS after the victim succumbed to injuries.
The bail applications of the accused were dismissed by the local court earlier. Seeking bail, the counsel for the accused, said Roy, who is a bright student and preparing for the various examinations, was falsely implicated in the case.
According to the police, certain persons were making videos while two cars were racing on the Sector 9/10 road and it was at that time the BMW car hit the cop. The complainant took the victim to the hospital.
