Chandigarh, January 21

The Punjab and Haryana High Court today issued a notice of motion to the Chandigarh Administration on a petition for not promoting DSP Ram Gopal on the basis of an order passed by the Central Administrative Tribunal’s Chandigarh Bench on February 13 last year, during the pendency of the writ petition.

Taking up the petition filed by Jaswinder Singh and another petitioner, the Bench of Justice Nirmaljit Kaur and Justice Meenakshi I Mehta also fixed March 3 as the next date of hearing in the matter.

The Bench was told that the petitioners’ case was simple. Ram Gopal was not entitled to accelerated seniority on account of his out-of-turn promotion. Moreover, the seniority list of inspectors was already subjudice before the High Court and could not be treated as final.

The petitioners submitted that they filed an application with a prayer for declaring them senior to Ram Gopal in the cadre of DSP, with all consequential benefits. The application filed by the petitioners was dismissed on February 13, 2020.
