Chandigarh, December 18

The court of Additional District and Sessions Judge has awarded 10-year imprisonment to a Mohali resident for carrying banned injections. The court also imposed a fine of Rs 1 lakh on the convict, identified as Sahil Kaushal (31).

According to the prosecution, during patrolling a police team saw a youth carrying a red polythene carry bag around 7 pm on June 30, 2017 in Sector 33, Chandigarh. During the checking of the bag, the police recovered 20 injections of buprenorphine of 2 ml each and 20 injections of pheniramine of 10 ml each.

Following the recovery, a case under Section 22 of the NDPS Act was registered against Sahil and he was arrested.

After going through the facts of the case, the court observed: “The prosecution has been able to prove its case against the accused beyond reasonable doubt that Sahil was found in conscious possession of 20 injections of buprenorphine lobegesic without any legal permit or licence on June 30, 2017. As such, the accused is held guilty.”

Pleading leniency, Kaushal said in 2014, he had undergone a surgery and his food pipe had been replaced. His gall bladder and intestine were damaged. He is the only son of his aged parents, so lenient view be taken.

“The instances of the NDPS Act are on alarming rise and drugs have directly affected the youth and the entire social fabric of society. As per the notification of 2009, the entire quantity is to be considered to find out whether the recovery is commercial quantity or not instead of the pure contents of the contraband,” observed the judge and sentenced him to 10-year imprisonment under Section 22 of the NDPS Act and also imposed a fine of Rs 1 lakh on him.
