GMDA lodges FIRs against two illegal concrete plants

Thought-provoking Opinions, Expert Analysis, In-depth Insights and other Member Only BenefitsThe Gurugram Metropolitan Development Authority (GMDA) has lodged two FIRs at the Kherki Daula police station against two ready-mix concrete (RMC) plants for illegally resuming operations on the sector dividing road of sectors 78 and 79A, Gurugram, despite being sealed by the Haryana State Pollution Control Board (HSPCB) and having their unauthorised access points closed by the GMDA.
In August, enforcement teams of the GMDA and the HSPCB had sealed the plants, and blocked their unauthorised road access as they were operating without obtaining mandatory Change of Land Use (CLU) permission from the competent authority, and without a valid No Objection Certificate (NOC) from the HSPCB.
Despite these enforcement measures, both plants deliberately restarted operations, committing multiple violations.
The illegal activities not only caused damage to GMDA’s road infrastructure but also caused public nuisance and health hazards, and indicated disobedience of lawful authority.
The FIRs (no 388 and 389) have been registered under Section 3, Prevention of Damage to Public Property Act, 1984 (for causing mischief resulting in damage to public infrastructure such as GMDA roads); Section 223(a), Bharatiya Nyaya Sanhita (BNS); Section 280, BNS; Section 329(3), BNS; and Section 61, BNS, (for criminal conspiracy, where the owners, managers and representatives of the RMC plants acted jointly to carry out illegal operations despite prior sealing and closure).
The GMDA has also formally requested the Haryana State Pollution Control Board to take stringent action against both plants under relevant provisions of environmental law.
GMDA DTP RS Batth said: “Public infrastructure belongs to the people, not private violators. The GMDA will continue to act firmly against any misuse or encroachment, in coordination with the pollution control board and law enforcement agencies. We will not allow illegal operations that endanger public health or obstruct urban infrastructure.”
