While passing this order, Justice Sandeep Sharma observed that “though this court is fully alive to the situation that it is the sole prerogative of the government to create infrastructure or department in a colleges or department concerned, but having taken note of the urgency in the matter, where National Medical Council (NMC) guidelines provide for creation of the department, as detailed hereinabove, this court has issued the aforesaid direction so that ultimately students are not made to suffer on account of non-compliance of guidelines issued by the NMC or omission, if any, on the part of Department of Medical Education & Research.”
The court further ordered to file compliance to the direction contained in the aforesaid order within a period of two weeks, after expiry of six months and same would be placed before the court for its perusal.
The court passed this order on a petition filed by one Dr Richa Gupta seeking directions to state government to fill up the post of Assistant Professor in the Department of Immunohematology and Blood Transfusion in Dr YSP Government Medical College, Nahan,
During the course of hearing it was brought to the notice of the court that as per NMC guidelines, nomenclature of blood bank is required to be changed to Department of Immunohematology and Blood Transfusion and at present, such Department does not exist in colleges.
Taking note of this, the court disposed of the petition with a direction to state to ensure creation of Department of Immunohematology and Blood Transfusion, in medical colleges situated in the state of Himachal Pradesh, where such department is not in in existence as of today, especially when it cannot be disputed that aforesaid department is very much essential in a medical college.
