High Court rejects Shimla SP’s plea against Dharamsala MLA

The Himachal Pradesh High Court has refused to take suo motu cognizance of the matter of sharing the live streaming video of the hearing related to the Vimal Negi case on social media. An application was filed on behalf of the Superintendent of Police, Shimla, requesting that suo motu cognizance be taken against BJP MLA Sudhir Sharma and contempt proceedings be initiated against him.

Justice Ajay Mohan Goel rejected the application and observed “taking into consideration the fact that the writ petition already stands disposed of, this court is of the considered view that it has become infructuous as far as the issues raised in the application are concerned. If the applicant has any grievance, he is well advised to independently approach the appropriate court/fora by way of an appropriate application or appropriate petition for the redress of the said grievance(s).”

The court observed that “the prayer made by the Advocate General that this court should suo motu take cognizance of the events narrated in the application is rejected. The application is dismissed. However, this court has not made any observation on the merit of the issues urged in the application”.

The Shimla SP alleged in the application that Sudhir Sharma had shared the live streaming on social media in a negative manner to malign his image with malicious intent for his own selfish interests, contrary to the rules of the state High Court.

The SP has filed this application in a disposed of petition filed by Kiran Negi, wife of Vimal Negi, seeking the transfer of investigation from the state police to the CBI and the court on May 23 allowed the same and transferred the investigation to the CBI.
