SC refuses to entertain MBBS student’s plea against termination of his admission in Odisha medical college

The Supreme Court on Tuesday refused to entertain an MBBS student’s challenging termination of his admission in a medical college in Odisha without prior notice.

“The plea is dismissed as withdrawn,” a Bench of Justice Rajesh Bindal and Justice R Mahadevan told the petitioner’s advocate Harshit Agrawal and asked him to move the high court with his grievances.

The student moved the top court seeking re-admission to the MBBS course for the 2024–2029 academic session and a declaration that the termination of his admission, allegedly carried out without any notice or hearing, was illegal and in violation of principles of natural justice.

He demanded formulation and enforcement of uniform procedural safeguards in disciplinary matters across medical colleges to ensure transparency and fairness.

His counsel referred to a previous instance where the top court had issued notice on a similar petition of another MBBS student who had challenged the vacation of interim protection against termination of admission. He told the Bench about a related transfer petition pending hearing on July 14.

As the Bench made it clear that it wasn’t inclined to entertain the petition, the petitioner’s counsel chose to withdraw the petition.
