Questioning the “legislative majority test” applied by the Maharashtra Legislative Assembly Speaker to decide that Chief Minister Eknath Shinde-led faction was the real Shiv Sena, the Supreme Court on Thursday summoned the original records relating to the disqualification row from the Speaker’s office.

“The original records shall be summoned from the office of the adjudicating authority (Speaker Rahul Narwekar),” a three-judge Bench led by Chief Justice DY Chandrachud said while hearing the Uddhav Thackeray-led Shiv Sena faction’s plea against the Speaker’s order declaring the Shinde-led faction as the “real” Shiv Sena following the June 2022 split in the party.
