A notice issued to Bikram Singh Majithia by the special investigation team (SIT) was today withdrawn by the state, following which a petition filed by Punjab’s former minister before the Punjab and Haryana High Court was rendered infructuous.

As the matter came up for resumed hearing, the state counsel at the very onset told the Division Bench of Acting Chief Justice GS Sandhawalia and Justice Vikas Bahl that the notice under Section 91 of the Code of Criminal Procedure regarding summons to produce document or other thing stood withdrawn.

Taking a note of the submission, the Bench made it clear that the state would be bound by the statement before disposing of the plea as infructuous. Majithia had moved the high court challenging the notice through senior advocate Ashok Aggarwal with counsel DS Sobti against the state of Punjab and other respondents.

The state counsel, on the previous date of hearing, on instructions from SIT Chairman HS Bhullar had submitted: “As per the notice dated June 7, necessary questionnaire and the relevant record were to be submitted to the SIT under Section 91 of the CrPC by June 18.”

It was further submitted that the SIT officials were busy in VIP movement. As such, the authorities had informed the petitioner that the date for submission of the questionnaire and relevant record stood postponed to June 20.

He was reprsented by senior advocate RS Cheema today.
